R- 02- 12- 19 -9D4 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ( "Contract ") with Rodriguez Transportation Group, Inc. to complete Phase I and provide inspection services for A.W. Grimes Boulevard, and to complete the design of Phase II for A.W. Grimes Boulevard, and WHEREAS, Rodriguez \Transportation Group, Inc. has submitted Supplemental Agreement No. 2 to the Contract for a change in the scope of services and to extend the contract date, and WHEREAS,the City Council desires to enter into said Supplemental Agreement No. 2 to the Contract with Rodriguez Transportation Group, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 2 to the Contract with Rodriguez Transportation Group, Inc., a copy of same being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on the 14 of June, 2001 to complete Phase I and provide inspection services for A.W. Grimes Boulevard, and to complete the design of Phase II for A.W. Grimes Boulevard and Gattis School Road, and WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires the termination of the Contract on December 31, 2002 unless the Contract is extended, and WHEREAS, ARTICLE 4, COMPENSATION, establishes the maximum lump sum payable under this contract at $915,993.89 without modification of the contract, and WHEREAS, it has become necessary to amend the contract to provide for the additional services for (1) storm sewer design, (2) waterline design, (3) hike/bike geometry, (4) misc. roadway geometry revisions, (5) pond spillway design, (6) section 404 permit support, (7) ROW and field surveys, (8) hydrologic studies for Dry Branch and Brushy Creek, and WHEREAS, it is in the City's best interest to extend the term of the Contract until December 31, 2003, and WHEREAS, the Engineer has agreed to have the additional work performed for $338,488.98 increasing the lump sum fee for the contract to $1,254,482.87. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 3, CONTRACT PERIOD, shall be amended to extend the contract period to December 31, 2003, and ARTICLE 4, COMPENSATION, shall be amended by the changing the lump sum amount pay- able under this contract as $1,254,482.87. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 2 to the Contract for Engineering Services with Rodriguez & Huggins, Inc. to complete Phase I and provide inspection services for A.W. Grimes Boulevard, and to complete the design of Phase II for A.W. Grimes Boulevard. R-99-05-13-13B12 to establish the alignment of Arterial B from US 79 to South of Louis Henna Boulevard, prepare a schematic of Arterial B, monument the alignment, and prepare the right of way documents for critical parcels. Supplemental Agreement No. 1 was approved on November 9, 1999 for additional surveying and engineering services related to preparation of right of way documents, construction plans, specifications and estimates for the construction of Arterial B from Louis Henna Boulevard to south of Louis Henna Boulevard along County Road 170. Supplemental Agreement No. 2 was approved on January 13, 2000 to provide for construction cost estimates for SH 45 from Arterial B to County Road 172 and to establish the center line of SH 45 from west of Greenlawn to Doublecreek Drive and construction plans for Arterial B from Louis Henna Boulevard to US 79.
