R- 02- 12- 19 -9D7 WHEREAS, the City of Round Rock has previously entered into a contract for engineering services ( "Contract ") with Carter & Burgess, Inc. for the preparation of plans, specifications, and estimates for 1.5 miles of US 79 from FM 1460 to CR 195, and WHEREAS, Carter & Burgess, Inc. has submitted Supplemental Agreement No. 5 to the Contract for a change in the scope of services, to include additional design work, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 5 to the Contract with Carter & Burgess, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 5 to the Contract with Carter & Burgess, Inc., a copy of said supplemental agreement being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted . WITNESSETH WHEREAS, the City and the Engineer executed a contract on the 23` day of March 2000 concerning the design of a four -lane divided section on US 79 from FM 1460 to CR 195 to include bridge design at Arterial A; and, WHEREAS, Article 2, Scope of Services To Be Provided by Engineer, as amended, establishes engineering services to be performed in fulfillment of the Contract; and, WHEREAS, Article 3, Contract Period, requires work to be completed on or before close of business on December 31, 2002; and, WHEREAS, Article 4. Compensation, as amended, limits the maximum amount payable for the contract to $684,862; and, WHEREAS, it has become necessary to further amend the contract; AGREEMENT NOW THEREFORE, premises considered, the City and the Engineer agree that said contract is amended as follows: I. The Engineer has been/will be performing additional services as shown in Exhibit B. II. The Contract termination date is extended to December 31, 2003. III. Scope of work included coordination with adjacent landowners, TxDOT and utility entities. SA#1 — Executed on June 28, 2001 ($158,118) 1. Extended the work limits 1400' to the west of existing FM 1460. Needed to perform a design survey, right of way map preparation, parcel research and utility locations. 2. Design (horizontal and vertical alignments, drainage, signing, striping, delineation, traffic control, etc.) needed to be generated for this area. 3. Design an additional bridge at Arterial A, and soil borings for that bridge. 4. Analysis of the existing 3 -6'x6' box culverts west of FM 1460. 5. Coordination with landowners. SA #2 — Executed September 13, 2001 ($68,021) 1. Field survey to be used for the design of illumination requested by the City of Round Rock between DI to CR 122, excluding the Dell Diamond portion. 2. Illumination design between 11135 and CR 122. TxDOT requested that the illumination be divided into two parts. The first portion is the illumination that is within the project limits of the GAP and be included in the construction documents being prepared. The remaining portion is to be a stand -alone construction plan set from HI 35 to FM 1460 and from Dell Diamond to CO 122. The preparation of the second plan set was not estimated. SA #3 — Executed January 10, 2002 — ($27,275) 1. Field survey new improvements near tie -in by Old Settlers Park 2. Right of way survey increase from original scope of work. A. Consider a resolution authorizing the Mayor to execute Supplemental Agreement No. 5 to the Contract for Engineering Services with Carter & Burgess, Inc. for improvements to US 79 from FM 1460 to CR 195. Resource: Jim Nuse, Chief of Operations /Assistant City Manager Tom Word, Director of Transportation Services History: The City Council approved Supplemental Agreement No. 2 at its regular session on September 13, 2001 as Resolution No. R- 01- 09- 13 -15F9 to provide for a change in the scope of services to develop plans and specifications for additional illumination of US 79. Approval of Supplemental Agreement No. 3 on January 10, 2002 allowed for additional field surveying and right -of -way surveying. Supplemental Agreement No. 4 covered the additional services of additional survey along Park Valley Lutheran Church/Existing US 79 right of way for embankment placed within the future right of way for the project; 16" waterline adjustment on the west side of FM 1460 crossing under the existing US 79 needs a new crossing so that casing will extend beyond the new pavement limits and relocation of fire hydrants and water valves; Changing of the westbound bridge width from 40' to 58' increased design cost because both the eastbound and westbound were originally the same width and therefore some of the bridge design could be applied to both bridges. Supplemental Agreement No. 5 will cover the additional work of: (1) Survey, right of way information preparation, and drainage design, traffic control plan development and environmental investigation for the box culvert from the HEB tract to Brushy Creek; (2) Preparation of waterline parcel easement documents west of existing FM 1460/US 79 and 4 additional waterline parcel easements from Palm Valley to Dell Diamond; (3) Coordination with John Lewis and his engineer and surveyor throughout the project duration (on going activity); (4) Designed a profile for the eastbound travel lanes (existing pavement), TxDOT request; (5) Revise small sign design due to new TxDOT standards; (6) Revise construction plans due to revisions in the TxDOT roadway design manual for left/right turn lanes (geometry, striping, signing).
