R-02-12-19-9D9 - 12/19/2002WHEREAS, the City of Round Rock has previously entered into a Contract for Engineering Services ( "Contract ") with HDR Engineering, Inc. for the design of the East Water Transmission Line (Phase II) Improvements, and WHEREAS, HDR Engineering, Inc. has submitted Supplemental Agreement No. 1 to the Contract to extend the contract date, and WHEREAS, the City Council desires to enter into said Supplemental Agreement No. 1 with HDR Engineering, Inc., Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to execute on behalf of the City Supplemental Agreement No. 1 to the Contract with HDR Engineering, Inc., a copy of said agreement being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. R- 02- 12- 19 -9D9 ELL, Mayor STATE OF TEXAS THE COUNTY OF WILLIAMSON SUPPLEMENTAL AGREEMENT NO. 1 TO CONTRACT FOR ENGINEERING SERVICES This Amendment to the Contract for Engineering Services is made by and between the City of Round Rock, Texas, hereinafter called the "City", and HDR Engineering, Inc., hereinafter called the "Engineer ". WHEREAS, the City and Engineer executed a Contract for Engineering Services, hereinafter called the "Contract ", on August 9, 2001 to design the East Water Transmission Line (Phase II) Improvements Project (Resolution No. R-01-08-09-13E4), and WHEREAS, ARTICLE 2, SCOPE OF SERVICES TO BE PROVIDED BY ENGINEER, describes those engineering services to be provided by the Engineer as a part of the Contract, and WHEREAS, ARTICLE 3, CONTRACT PERIOD, requires the termination of the Contract on May 1, 2003 unless the Contract is extended, and WHEREAS, ARTICLE 4, COMPENSATION, establishes the total fees payable under the Contract at $370,900.00 without modification of the Contract, and WHEREAS, it has become necessary to amend the contract to extend the Contract termination date and change the Engineer's subconsultant for surveying services. NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract is amended as follows: ARTICLE 3, CONTRACT PERIOD, shall be amended to extend the contract period to August 1, 2004, and ARTICLE 4, COMPENSATION, Paragraph A. Design Phase and Paragraph C. Construction Phase shall be amended to change the subconsultant "Baker - Aicklen & Associates, Inc." to "Inland Civil Associates, Inc. ", and ATTACHMENT "C ", Work and Fee Schedules shall be amended as set forth in the attached ADDENDUM to ATTACHMENT "C ", which consists of a revised project schedule dated November 18, 2002. This supplemental Agreement will extend that date to August 1, 2004. HDR's work on this was delayed about a year waiting for TxDOT to establish a route for the realignment of FM 1460 between Chandler Road and CR 113. The City requested HDR to wait for TxDOT's realignment in order the new 36 -inch water line could be installed within easements outside TxDOT's right -of -way. This Supplement has been prepared to: 1) extend the Contract termination date and 2) change HDR's designated subconsultant for surveying services. The present termination date for the Contract is May 1, 2003. This project has been delayed approximately one year waiting for TxDOT to establish a route for the realignment of State Highway FM 1460 between CR 113 and Chandler Road. TxDOT has established a proposed route and the project can now proceed. It is proposed that the Contract termination date be extended to August 1, 2004. A revised project schedule is attached to Supplement No. 1. Baker - Aicklen & Associates, Inc. is designated as HDR's subconsultant for surveying services in the Contract. Since the Contract was executed in August 2001, Inland Civil Associates, Inc., has performed a substantial amount of surveying in the FM 1460 corridor under a work order from TxDOT. In the interest of time and cost savings for the City, HDR requested a proposal from Inland Civil for design and easement acquisition surveying services for the 36 -inch transmission line. Inland's proposed cost is about $9,000 less than the Contract amount allocated to Baker - Aicklen. HDR recommends that the Contract amount not be adjusted at this time, and that this potential cost savings be held as a contingency in the event that additional surveying or other services are required over the course of the Contract.
