WHEREAS, the City of Round Rock wishes to enter into an
agreement with the Capital Area Rural Transportation System (CARTS) for
a 3 -month extension of public transportation services in Round Rock,
Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City said agreement, a copy of same being attached hereto
as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

This is an agreement (hereinafter referred to as the
"Agreement, ")between the City of Round Rock (hereinafter "City "),
and Capital Area Rural Transportation System (hereinafter
"CARTS "), for the City to provide funding for services received
by the city of Round Rock, Texas, from CARTS for the time period
of January 1, 2003 through March 31, 2003.
The City finds that through is services, CARTS accomplishes a
public purpose and benefits the community of Round Rock, Texas.
Further, the City finds that the services, which will be provided
by CARTS pursuant to this Agreement, are services that the City
would provide, absent the Agreement, within the vision and
limitations otherwise placed upon the City. CARTS provided these
services for the City, in the past, and desires to continue to
provide these services.
In consideration for the services to be provided by CARTS, the
city agrees to pay an amount of $ 25,000, to be paid in three (3)
equal monthly installments within 30 days upon receipt of invoice
from CARTS.
As consideration for the funds to be provided by the City, CARTS
agrees to provide the following as a condition of this Agreement:
A. General public transportation for the citizens of Round
Rock with emphasis on the elderly and handicapped.
Destinations will include but will not be limited to,
medical facilities, grocery stores and other merchants,
post office, doctors, etc.
B. Coordination as appropriate with the City and other
community service providers in the provision of services
to Round Rock residents.
C. The services are to be provided on a Monday through Friday
basis, excluding CARTS official holidays. The hours of
service and routes to be continued are outlined on
Attachment "A" to this agreement:

IV. AMENDMENT AND ASSIGNMENT
This Agreement shall be altered, waived, amended or extended,
without the prior written consent of both parties.
CARTS may not assign this Agreement to another party without the
prior written consent of the City. All notices regarding
assignment shall be given as proved in Paragraph V. It is
further agreed that this Agreement shall be binding upon the
administrators, executors and assigns of the parties.
V. TERMINATION
Either party may terminate this Agreement for any reason upon
thirty (30) days written notice to the other party. Such notice
shall be hand - delivered or sent by certified mail, return receipt
requested, to the following address:
VI. Extension of Agreement
This agreement can be extended by mutual agreement on a month -by-
month basis as needed in the form a letter to that effect
directed to CARTS by the City of Round Rock.

medical, and other trip purposes as needed.
902 Taylor to Round Rock:
This route provides weekday service from eastem Williamson County into Round Rock and then provides
local service in Round Rock between 10:00 a.m. and 3:00 p.m.
903 Round Rock and Cedar Park:
This route provides weekday service in Cedar Park and Round Rock. Service begins in Cedar Park and
transports persons into Round Rock for medical and shopping. Once there, at approximately 10:00 a.m., it
serves as a backup to routes 902 and 905 providing for additional pickups and retums inside Round Rock until
departure for Cedar Park at 3:00 p.m.
905 Round Rock Route:
This route provides weekday service within the city limits of Round Rock between 8:00 a.m. and 5 p.m.

History: The Capital Area Rural Transportation System (CARTS) has provided public
transportation service in Round Rock for many years. CARTS has received funding
for the other rural transportation program from the Federal and State government,
which covered the majority of the cost of this service. Because of Round Rock's
population, the City is no longer eligible for the Federal and State funding. This
agreement will provide a 3 -month continuation (from January through March) of
public transportation services in Round Rock at a cost of $25,000.

Impact/Benefit: Elderly and disable citizens will continue to receive public transportation

10E6 at their regularly scheduled meeting on January 23, 2003. This
resolution approves an agreement for a 3 -month extension of public
