WHEREAS, the City of Round Rock has previously entered into an
Agreement for Engineering Services with Baker - Aicklen & Assoc., Inc.
for the G.O. Bond Downtown Streets, Phase 1 Project, and
WHEREAS, Baker - Aicklen & Assoc., Inc. has submitted Supplemental
Agreement No. 1 to the Agreement for Engineering Services for a change
in the scope of services, and
WHEREAS,the City Council desires to enter into said Supplemental
Agreement No. 1 with Baker - Aicklen & Assoc., Inc. , Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 1 to the Agreement for
Engineering Services with Baker - Aicklen & Assoc., Inc., a copy of same
being attached hereto as Exhibit "A" and incorporated herein for all
purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

SUPPLEMENTAL AGREEMENT NO. 1
TO AGREEMENT FOR ENGINEERING SERVICES
This Supplemental Agreement No. 1 to Agreement for Engineering Services is made by and
between the City of Round Rock, Texas, hereinafter called the "City" and Baker - Aicklen & As-
soc., Inc., hereinafter called the "Engineer ".
WHEREAS, the City and Engineer executed an Agreement for Engineering Services, hereinaf-
ter called the "Agreement ", on September 12, 2002 to provide Preliminary Engineering Services
for the G.O. Bond 2002 - Downtown Streets, Phase I, and
WHEREAS, it has become necessary to amend the Agreement to provide for additional engi-
neering services, additional compensation, and an extension of the contract period;
NOW THEREFORE, premises considered, the City and the Engineer agree that said Contract
is amended as follows:

ARTICLE 2, SCOPE OF SERVICES TO BE PERFORMED BY ENGINEER and EXHIBIT B,
SERVICES TO BE PERFORMED BY THE ENGINEER shall be amended as set forth in the
attached ADDENDUM to EXHIBIT B.

ARTICLE 3, CONTRACT PERIOD, shall be amended to extend the contract period to Novem-
ber 30, 2004.

ARTICLE 4, COMPENSATION, shall be amended by the adding $105,264.55 to the original
lump sum amount of $63,634.31 to make the amended lump sum payable under this Agreement

BAKER - AICKLEN AND ASSOCIATES, INC.
SCOPE OF SERVICES
Re: G. O. Bond 2002 — Downtown Streets — Phase I
Final Street Design, Water and Wastewater Design, submit support documentation and
calculations to TCEQ as related to WPAP & SCS, Stormwater Pollution Prevention Plan
(SWPPP), Texas Department of Licensing and Regulation (TDLR) Submittal Variances,
Additional Topographic Survey, Right -of -Way Field Notes with Sketches,
Permitting/Bidding /Approvals, and Construction Phase Administration. Also included in this
additional Scope of Services is Preliminary & Final Design of Street, Drainage, Water and
Wastewater improvements to Nelson Street from Main Street to East Austin Avenue. Final
Design services for Nelson Street are included in Items C — H below.
A. Nelson Street Right -of -Way and Topographic Design Surveys
1. Coordinate with Utility Locators.
2. Deed Study and ROW Survey - Perform necessary right -of -way surveys to define
existing rights -of -way within project limits.
3. Topographic/Design Survey - Perform topographic/planimetric features survey
along the street with sufficient detail necessary to design the proposed
improvements. The limits of the survey along the street shall be a minimum of ten
feet outside one right -of -way (ROW) line to ten feet outside the opposite ROW line.
The survey shall include but not be limited to the following: Location of existing
rights -of -way, property comers, pavements, driveways, power /utility poles, utility
boxes, valves, fire hydrants, manholes, clean outs, roadside swales /ditches, signs,
trees, mail boxes, sidewalks, significant landscaping, meters, walls, etc., and
elevations at all abrupt grade changes. The survey shall also provide sufficient data
to describe in detail intersections of the streets under consideration with other
streets not contemplated herein to be reconstructed.
4. Set two (2) Benchmarks.
5. Provide Topographic Survey Drafting.
B. Right -of -Way Acquisition Surveys & Additional Topographic Design Surveys
1. Provide the surveying services to produce certified sketches and metes and bounds
descriptions for thirteen (13) separate right -of -way acquisition parcels. Each parcel
will also be monumented along the proposed new right -of -way.

In addition, additional topographic design surveys will be provided along the north
side of Pecan Street at two (2) locations.
C. Nelson Street Preliminary Engineering Design
1 Coordination of Subconsultants. (Provide geotechnical investigation and
recommendation of pavement design.)
2. Collect and review data.
3. Identify Issues.
4. Prepare base maps.
5. Prepare preliminary drainage analysis & schematic.
6. Prepare utility relocation analysis & schematic.
7. Prepare Preliminary Plan & Profile sheets.
8. Prepare Preliminary Engineer's Opinion of Probable Construction Cost and
submittal of Preliminary Engineering Documents to City.
9. Meetings with City.
D. Project Coordination
1. Attend project coordination meetings with the City to discuss project goals and
requirements. (Assumes six (6) meetings.)
2. Attend public meetings, as requested by the City. (Assumes two (2) meetings.)
3. Coordinate with local utility providers for utility relocations.
E. Final Design .
1. Prepare overall erosion/sedimentation control and tree protection plan.
2. Prepare overall drainage plan with runoff and inlet calculations, as required.
3. Prepare plan and profile sheets.
4. Prepare Veteran's Park parking lot dimensional control and grading plan.
5. Prepare utility plan.
6. Prepare wastewater profiles.
7. Prepare storm sewer profiles.
8. Prepare cross sections at one hundred foot (100') intervals.
9. Prepare cover sheet, construction notes sheet, construction details and standards in
order to relay sufficient detail for contractibility.
F. Review — Permitting — Approvals
1. Submit construction plans and support documentation to TDLR for project review
and variances, as required.
2. Address review comments /secure City approval. (Two (2) submittals.)
3. Prepare SWPPP and assist the City and Contractor with the submission of the
Notice of Intent.
4. Prepare support documentation and calculations, as required by the TCEQ, to
secure WPAP exemption approval.

5. Prepare support documentation and calculations for wastewater improvements, as
required by the TCEQ, to secure their approval/concurrence.
G. Bidding Phase
1. Prepare quantity take -offs.
2. Prepare Engineer's Opinion of Probable Construction Cost.
3. Prepare Final Bidding/Contract documents.
4. Advertise project in local newspapers.
5. Distribute plans and specifications to prospective bidders.
(Reproduction/Distribution costs are reimbursable expenses.)
6. Schedule and attend pre -bid conference. Answer contractor questions and issue
addenda, if required.
7. Compile and analyze bid tabulations and submit recommendations for award of
contract.
H. Construction Phase Administration
Services Not Included in the Scope of Services
1. Conduct pre - construction conference.
2. Review shop drawings, samples, schedules, and submittals.
3. Interpret drawings and specifications, as related to RFI's.
4. Perform weekly site visits to observe construction for general conformity to the
construction documents. -
5. Observe testing of water and wastewater lines.
6. Attend bi- weekly construction progress meetings. (Assumes nine (9) months
construction.)
7. Review Contractor's pay estimates.
8. Prepare final punch list.
9. Prepare "Record Drawings" and provide City an electronic computer aided drafting
file of final plans.
10. Issue Contractor's Certification of Completion.
Walls over three feet in height, structural water quality ponds, detention ponds, phase one
environmental site assessments, wetland issues, trench safety design, landscape plans,
TIA reports, and fees charged by reviewing agencies.

roadway, utility and drainage schematics, and cost estimates. Supplemental
Agreement No. 1 is needed to proceed with right -of -way acquisition, final
plan preparation and construction. Supplemental Agreement No.1 is for final
engineering and construction phase services and will also provide preliminary
engineering for Nelson Street for which improvements are being
contemplated.

Cost: $ 105,264.55
Source of funds: Capital Project Funds (2001 G. O. Bond)

E. Final Design
In addition, additional topographic design surveys will be provided along the north
side of Pecan Street at two (2) locations.
1. Prepare overall erosion/sedimentation control and tree protection plan.
2. Prepare overall drainage plan with runoff and inlet calculations, as required.
3. Prepare plan and profile sheets.
4. Prepare Veteran's Park parking lot dimensional control and grading plan.
5. Prepare utility plan.
6. Prepare wastewater profiles.
7. Prepare storm sewer profiles.
8. Prepare cross sections at one hundred foot (100') intervals.
9. Prepare cover sheet, construction notes sheet, construction details and standards in
order to relay sufficient detail for constructibility.
F. Review — Permitting — Approvals
1. Submit construction plans and support documentation to TDLR for project review
and variances, as required.
2. Address review comments /secure City approval. (Two (2) submittals.)
3. Prepare SWPPP and assist the City and Contractor with the submission of the
Notice of Intent.
4. Prepare support documentation and calculations, as required by the TCEQ, to
secure WPAP exemption approval.

5. Prepare support documentation and calculations for wastewater improvements, as
required by the TCEQ, to secure their approval /concurrence.
G. Bidding Phase
1. Prepare quantity take -offs.
2. Prepare Engineer's Opinion of Probable Construction Cost.
3. Prepare Final Bidding/Contract documents.
4. Advertise project in local newspapers.
5. Distribute plans and specifications to prospective bidders.
(Reproduction/Distribution costs are reimbursable expenses.)
6. Schedule and attend pre -bid conference. Answer contractor questions and issue
addenda, if required.
7. Compile and analyze bid tabulations and submit recommendations for award of
contract.
H. Construction Phase Administration
1. Conduct pre - construction conference.
2. Review shop drawings, samples, schedules, and submittals.
3. Interpret drawings and specifications, as related to RFI's.
4. Perform weekly site visits to observe construction for general conformity to the
construction documents.
5. Observe testing of water and wastewater lines.
6. Attend bi- weekly construction progress meetings. (Assumes nine (9) months
construction.)
7. Review Contractor's pay estimates.
8. Prepare final punch list.
9. Prepare "Record Drawings" and provide City an electronic computer aided drafting
file of final plans.
10. Issue Contractor's Certification of Completion.
Services Not Included in the Scope of Services
Walls over three feet in height, structural water quality ponds, detention ponds, phase one
environmental site assessments, wetland issues, trench safety design, landscape plans,
TIA reports, and fees charged by reviewing agencies.
