R- 03- 07- 10 -10C1 WHEREAS, Section 13.02 of the Home Rule Charter for the City of Round Rock, Texas, provides that the Council shall designate a public newspaper of general circulation in the City as official publication for legal notices, and WHEREAS, the Round Rock Leader is a public newspaper of general circulation in the City, and WHEREAS, the Council is desirous of designating the Round Rock Leader as the official publication of the City, Now Therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Round Rock Leader is designated as the official publication of the City and all ordinances, notices and any other matter required to be published shall be published therein, and BE IT FURTHER RESOLVED that the Council hereby authorizes the Mayor to execute a one year agreement with Todd Publications, Inc. dba Round Rock Leader to provide the required services at its normal and usual rates, a copy of said agreement being attached hereto as Exhibit "A" and incorporated herein for all purposes. The City Council hereby finds and declares that written notice of the date, hour, place and subject of the meeting at which this Resolution was adopted was posted and that such meeting was open to the public as required by law at all times during which this Resolution and the subject matter hereof were discussed, considered and formally acted upon, all as required by the Open Meetings Act, Chapter 551, Texas Government Code, as amended. Blair Street, Round Rock, Williamson County, Texas, hereinafter called "TODD ": Whereas, TODD is the publisher of the Round Rock Leader, a public newspaper of general circulation in the city of Round Rock, and Whereas, the Home Rule Charter for the City provides that the Council shall annually designate a public newspaper as the official organ of the CITY, and Whereas, the Home Rule Charter instructs the Council to contract annually with a public newspaper, and Whereas, the Council has by resolution designated the Round Rock Leader as the official organ of the CITY; NOW, THEREFORE, IT IS AGREED AS FOLLOWS: I. TODD agrees to publish in the Round Rock Leader all ordinances, notices, and any other advertising matter required to be published by the Horne Rule Charter, the ordinance of the CITY, or the Constitution and /or laws of the State of Texas. TODD further agrees that all such matter in the form of legal liner advertising delivered to it's office by 3:30 PM on Monday will be published in the paper dated and delivered the Thursday immediately following, and that all such liner advertising matter delivered to it's office by 3:30 PM on Thursday will published in the paper dated and delivered the Monday immediately following. TODD further agrees that all such matter in the form of Display advertising delivered to it's office by 12:00 PM on Monday will be published in the paper dated and delivered the Thursday immediately following, and that all such Display advertising matter delivered to it's office by 5:00 PM on Wednesday will published in the paper dated and delivered the Monday immediately following. TODD further agrees that all such matter in the form of Maps and Illustrations delivered to it's office by 12:00 PM on Monday will be published in the paper dated and delivered the Thursday immediately following, and that all such Display advertising matter delivered to it's office by 5:00 PM on Wednesday will published in the paper dated and delivered the Monday immediately following. No discounts available. In addition to publishing Legal Liner advertising in the printed publication (newspaper), TODD agrees to publish legal liner advertising on our electronic publication (web site) at www.rrleader.corn at no additional charge. All accounts are due on the 25 of the month following publication. Past due balances will be accessed a service charge of 1.5 percent of total balance due, up to and including past service charges. The aforementioned rates to be held for one calendar year from the date this contract becomes effective. III. The obligations and undertaldngs of each of the parties to their agreement shall be performable in Round Rock, Williamson County, Texas. IV. This agreement shall be governed by and construed in accordance with the laws of the State of Texas. V. Resource: Will Hampton, Communication Director History: By Charter, the City is required to enter into a yearly agreement with a publication of general circulation to publish all officially required notices. The City annually solicits quotes from the Round Rock Leader and Austin American - Statesman for this Charter- required contract. Funding: Cost: The Leader is offering a rate of $7.50 per column inch for required notices, up from last year's rate of $7.00 per inch. The Statesman's quoted rate is $8.00 per column inch. So far this year, the City has spent $23,684 with the Leader and $40,738 with the Statesman for legal notices and other advertising.
