That the Mayor is hereby authorized and directed to execute on
behalf of the City Supplemental Agreement No. 1 to the Agreement for
Engineering Services with Espey Consultants, Inc., a copy of same being
attached hereto as Exhibit "A" and incorporated herein for all purposes.
The City Council hereby finds and declares that written notice of
the date, hour, place and subject of the meeting at which this
Resolution was adopted was posted and that such meeting was open to the
public as required by law at all times during which this Resolution and
the subject matter hereof were discussed, considered and formally acted
upon, all as required by the Open Meetings Act, Chapter 551, Texas
Government Code, as amended.

This Amendment to the Agreement For Engineering Services For The Study Of Onion Branch In
The Vicinity Of The Hermitage Project is made by and between the City of Round Rock, Texas,
hereinafter called the "City" and Espey Consultants, Inc., hereinafter called the "Engineer ".
WHEREAS, the City and Engineer executed an Agreement For Engineering Services For The
Study Of Onion Branch In The Vicinity Of The Hermitage Project, hereinafter called the
"Agreement ", on the 26`s day of September, 2002; and
WHEREAS, it has become necessary to amend the Agreement to provide for additional work in
the scope of services, additional compensation to the Engineer, and an extension in the contract
period;
NOW THEREFORE, premises considered, the City and the Engineer agree that said
Agreement is amended as follows:
I.
Article 2, Scope of Services to be Performed by Engineer, and Attachment `B ". Services to be
Provided by the Engineer shall be amended as set forth in the attached Addendum To Exhibit B.
II.
Article 3. Agreement Period, shall be amended to extend the contract period May 26, 2003 to
January 1, 2004.
Article 4, Compensation, shall be amended by adding $39,150.00 to the lump sum amount
payable under this Agreement for a total of $54,193.00.

"Services to be Performed by City"
The scope of Services to be performed by the City is to facilitate the engineering, permitting and design
of culvert improvements described in Exhibit B, by administering this contract and reviewing the work
performed by the engineer. The City shall:
1. provide to the engineer, without charge, copies as needed of all available maps, plans, as -built
drawings and any other information relevant to the project.
2. provide "Right of Entry" (landowner permission) if necessary for the engineer or his
subconsultants to access private property in order to perform the work.
3. shall meet with the engineer on a periodic basis to review the progress of the work, to answer
questions from the engineer, and for the purpose of commenting on the work.

"Services to be Performed by the Engineer"
The project site includes the immediate area on Onion Branch where the Georgetown Railroad crosses.
This proposed culvert upgrade is necessary to alleviate the frequent backwater flooding on Onion Branch
and the Hermitage Subdivision that is the result of existing culverts crossing under the Georgetown
Railroad (Figure 1). The proposed improvements will provide conveyance of stormwater runoff for a
design storm that is between a 2 -year and a 10 -year storm event based on economics and physical
constraints related to the crossing. Runoff flow rates that exceed the design storm will still continue to
overtop the Georgetown Railroad.

The scope of this project includes the development of construction plans for the design of as many as 8
box culverts with associated channel improvements for transitioning. Espey Consultants, Inc. (EC) will
solicit the support of subconsultants to provide survey and geotechnical services necessary to complete
this project.
I. Coordination with USACE and Notification — EC will coordinate and submit necessary
documents to the USACE for compliance with Section 404 of the Clean Water Act. At this time
it is anticipated that the activity will be covered under a "nationwide" permit and will not require
an "individual" permit. A nationwide permit will require approximately 45 day review / approval
time front the Corps.
2. Preparation of Construction Plans — Based on design criteria from the American Railway
Engineering & Maintenance of Way Assoc., cost, input from the City of Round Rock and
USACE, availability of materials, etc., EC will adjust the proposed design as necessary and
develop construction plans of the proposed improvements. Construction plans will include
appropriate general notes to contractor, erosion / sedimentation control measures, provisions for

securing existing utilities (manholes, wastewater laterals, etc.), plan and profiles of the channel
and box culverts, necessary cross - sections, details, etc. as required for construction by the
contractor. EC will coordinate with the Georgetown railroad for "sign oft" of a phasing plan and
construction documents. EC will prepare one draft set construction plans and one final mylar set
of construction plans with incorporated draft comments.
3. Preparation of Bid Documents and Specifications — EC will prepare bid documents that will
include contract documents and technical specifications using format and standard documents
provided by the City of Round Rock.
4. Bid Phase Services (limited) — EC will prepare a master copy of the bid documents for
reproduction at the CoRR's expense. EC will provide assistance at a pre -bid conference, the bid
opening, and tabulating bids, and will make a recommendation of award following review of bid
results. CORR will be primarily responsible for scheduling, conducting and holding meetings.
5. Water Pollution Abatement Plan — EC will prepare a water pollution abatement plan (WPAP) for
submittal and review by the TCEQ. EC will work with the TCEQ and modify the WPAP as
necessary for compliance with the Edwards Aquifer rules and approval by the TCEQ.
The scope of the project does not include:
1. bid phase services;
2. utility adjustments or relocations;
3. significant channel improvements other than that necessary to transition back to the existing
channel;
4. construction phase services; or
5. preparation of SW3P for compliance with TPDES.

History: The eastern edge of The Hermitage subdivision is within the 100 -year flood
plain. Even though the houses in the subdivision are somewhat elevated
and haven't experienced flooding, the streets will become inundated during
intense rainfall events. An analysis of the area was recently performed
under the original Professional services agreement approved by the Council
on 9/26/02. The analysis indicates that houses in the area are relatively
safe from flooding even during intense rainfall events. This Supplemental
Agreement will provide engineering services to design culvert improvements
to decrease the frequency in which streets in the area are inundated.
