R-77-140 - 4/7/1977RESOLUTION NO. 140R RESOLUTION RESOLUTION AUTHORIZING MAYOR OF THE CITY OF ROUND ROCK, TEXAS, TO GIVE NOTICE UNDER ARTICLE 14.46c, 43(d) TO LONE STAR GAS COMPANY TO SUSPEND OPERATION OF A SCHEDULE OF RATES AND TARIFFS PENDING A DETERMINATION BY THE CITY OF ROUND ROCK, TEXAS, CONCERNING THE SCHEDULE OF RATES PROPOSED BY LONE STAR GAS COMPANY FOR AN ADDITIONAL THIRTY DAYS. WHEREAS, heretofore Lone Star Gas Company filed a statement of intent to change rates for gas sold to residential and commercial customers within the city limits of Round Rock, Williamson County, Texas, such statement being filed on or about November 15, 1976; and, WHEREAS, the City of Round Rock, Texas, has been given written notice by Lone Star Gas Company that such change to rates are to be placed into effect on and after December 21, 1976; and, WHEREAS, the City Council of the City of Round Rock, Texas, did by Resolution dated December 13, 1976 authorize the Mayor of the City of Round Rock, Texas to notify Lone Star Gas Company on behalf of the City that there was a need to suspend the operation of the schedule of rates for a period of 120 days from December 21, 1976, so that the City might be furnished with data and information not only from Lone Star Gas Company, but from other sources and so that the City might have the needed necessary time for a study and determination based upon such data; and, WHEREAS Article 14.46c, Sec. 43(d), Vernon's Annotated Civil Statutes, makes provision for the suspension of the operation of such schedule of rates and tariffs for an additional extension of the period of suspension for an additional period of thirty (30) days if the need arises; and, WHEREAS the City Council of the City of Round Rock, feels that the additional thirty day period is needed in order to make a determination upon the proposed rate increase: THEREFORE, BE IT RESOLVED by the City Council of the City of Round Rock, Texas, hereinafter referred to as Regulatory Authority, that the Mayor of the City of Round Rock, Texas, shall notify Lone Star Gas Company on behalf of Regulatory Authority that there is a need to further suspend the operation of the schedule of rates for an additional thirty day period from April 19, 1977 so that regulatory authority may be furnished with additional data and information not only from Lone Star Gas Company but from other sources and so that Regulatory Authority shall have additional needed and necessary time for a study and determination based upon such data.
