R-78-154 - 1/24/1978WHEREAS, by previous action, the City.Council has deemed it necessary to acquire certain real estate to allow for the widening and improving of Highway 620, and WHEREAS, the estimated cost of acquiring the real estate including purchase price, court costs, and attorney's fees is $92,281.00, and WHEREAS, Section 8.07 of the Home Rule Charter For The City of Round Rock, Texas provides that the city may borrow up to ten percent (10 %) of the budget for that fiscal year, and WHEREAS, the budget for the fiscal year exceeds $1,500,000.00, THEREFORE, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, THAT: The City Manager be authorized to borrow up to $92,281.00 from Farmers State Bank of Round Rock, to be used in the acquisi- tion of the necessary real estate for the Highway 620 project. ATTEST: RESOLUTION E OZ/Uil '/anne Land, Ci Secretary RESOLUTION NO. 154R z Ray Litton, Mayor City of Round Rock, Texas REAL ESTATE SALES CONTRACT THIS IS A CONTRACT whereby the Round Rock Independent School District herein called Seller, agrees to sell to the City of Round Rock, Texas, herein called Buyer, who agrees to purchase, upon the terms and provisions hereof, the following described real property, in its present condition, situated in Williamson County, Texas, to- wit: 0.786 acre of land, more or less, out of the Jacob M. Harrell Survey, Abstract No. 284, in Williamson County, Texas, and being part of a tract conveyed to Round Rock Independent School District by the following deeds recorded in Deed Records of Williamson County, Texas: Austin White Lime Company to Round Rock Independent School District recorded in Volume 529, Page 265, and John A. Pfluger and Edgar W. Smith to Round Rock Independent School District recorded in Volume 529, Page 267 and Volume 529, Page 268, Said 0.786 acre tract of land, more or less, being more described by metes and bounds.as follows: t . a.. s� BEGINNING at a point for the northwest corner of the Round Rock Independent School District tract of land, said point being the northeast corner of a tract conveyed to N. Highway 620; THENCE with the said existing right of way line along a curve to the right, the radius of which is 872.93 feet, an arc distance of 186.26 feet, the chord of which bears South 66 ° 55'57" East, 185.90 feet to a point of tangency; THENCE continuing along said existing right of way line, South 60°49'12" East, 216.50 feet to the point of a curve; THENCE along a curve to the left the radius of which is 979.13 feet, an arc distance of 113.22 feet, the chord of which bears South 64 °07'57" East, 113.15 feet to a point for the east corner of the tract herein described; said point being 60 feet right of and normal to proposed R. M. Highway 620 relocated Centerline Station 474 +07.50; THENCE with the proposed new south right of way line of R. M. Highway 620, along a curve to the right having a radius of 3879.72 feet, an arc distance of 320.49 feet, the chord of whicha bears North 76°26'59" West, 320.40 ,feet, _t -- -/~' point; THENCE along said proposed right of way line South 55°33'09" 41,73 feet to a point; THENCE continuing along said proposed right of way line South 81° 40'West, 89,21 feet to a point in the grantor's west property line, from which point the grantor's southwest property corner bears South 8 °20'East, a distance of 2 186 ±.feet; said point also being 128.78 feet right of and normal to said R. M. Highway 620 relocated Centerline Station 469 +84;01; THENCE along said west property line, North 8 ° 20'West, 191.25 feet to the point of beginning. The total sales price is $11,790.00, payable upon the closing of this transaction. Seller is to furnish Buyer an OWNER'S POLICY OF TITLE INSURANCE at Buyer's expense issued by a title company of Buyer's choice, tax certificates showing no delinquent taxes, (current taxes, to be prorated to date of closing) a General Warranty Deed to be recorded at Buyer's expense, conveying good and marketable title. The Owner's Policy of Title Insurance to be furnished hereunder is to be delivered as and when the sale is closed, which be within forty -five (45) days from date hereof unless attorneys for said Title Company discover objections to title, in which case sale is to be closed when objections are removed, provided the objections are removed within a reasonable time, which in no event shall extend beyond sixty (60) days from date hereof. It is agreed that by the delivery of Owner's Policy of Title Insurance (form prescribed by State Board of Insurance of the State of Texas) under the terms of this contract, dated as of the date of closing and issued to Buyer in the amount of the total sales price, guaranteeing Buyer's title to be good and indefeasible subject only to the following: 1. Restrictive covenants affecting the land described or referred to above. 2. All taxes for the current and subsequent years. all duties of the Seller as to the sufficiency of title required hereunder shall be deemed to be fully performed by Seller; however, Seller shall not thereby be released from the warranties of his deed. This contract is expressly contingent upon Buyer being able to acquire title to all of the property needed to complete the widening and straightening of Highway 620. 1977. Time is of the essence of this contract.
