A RESOLUTION ADOPTING THE CITY OF ROUND ROCK SECTION 3 AFFIRMATIVE
THE STATE OF TEXAS
ACTION PLAN.
WHEREAS, Section 3 of the Housing and Urban Development Act of
1968 requires to the greatest extent feasible the hiring of local residents
and the awarding of contracts to local business concerns in connection
with certain federally funded projects; and
WHEREAS, the City of Round Rock, Texas, wishes to comply with
the requirements stated therein; now
THEREFORE, be it resolved by the City Council of Round Rock that
the Section 3 Affirmative Action Plan attached hereto as "Exhibit A" is
hereby approvedtand adopted. _ '

EXHIBIT A
CITY OF ROUND ROCK
SECTION 3 AFFIRMATIVE ACTION PLAN
This Plan has been developed to comply with Section 3 of the Housing
and Urban Development Act of 1968 which requires, to the greatest extent
feasible, opportunities for training and employment arising in connection
with the planning and implementation of any project assisted under any such
program to be given to lower income persons residing in the area of such
project and that to the greatest extent feasible contracts for work to be
performed in connection with any such project to be awarded to business
concerns, which are located in or owned in substantial part by persons
residing in the area of such project.
(A) Definitions
(1) Applicant - any entity seeking assistance for a project including
but not limited to mortgagors, developers, local public bodies,
non - profit or limited dividend sponsors, builders or property
managers.
(2) Recipient - any entity who received assistance for a project
including but not limited to mortgagors, developers, local
public bodies, non - profit or limited dividend sponsors, builders
or property managers.
(3) Section 3 Project - any non - exempt project assisted by any
program administered by the Secretary of Housing and Urban
Development in which loans, grants, subsidies, or other
financial assistance are provided in aid for housing, urban -
planning, development, redevelopment or renewal, public or
community facilities.

(4) Contractor -`any entity which performs work - in connection with
a Section 3 covered project.

The Recipient shall, to the greatest extent feasible, make a
good faith effort to train, employ or cause to be employed, lower
income residents on the project(s) and shall make a good faith effort
to use on the project(s), the services of businesses located in or
substantially owned by persons who live within the project boundaries.
In the administration of the program, aid will be given for assistance
in housing, urban planning, development, renewal, public or community
facilities and community development.
(C) Employment of Administrative, Para - Professionals, Technicians,
Clerical and Service Maintenance Personnel by the City of Round
Rock.
(See Table 1 - Existing Positions in the City of Round Rock)
These employees will administer the Community Development Activities.
The Recipient will attempt to meet the goal of providing equal
opportunity for all those residents and businesses within the political
jurisdiction of the City of Round Rock.
(D) Utilization of Section 3 Project Area Businesses:
The Recipient will, to the greatest extent feasible, attempt to
utilize wherever possible the services of those businesses located
within the Section 3 Project Area for the undertaking of the above
activities.
(E) Good Faith Effort:
The Department will make a good faith effort, to the greatest
extent feasible, to require:
(1) each applicant, recipient, contractor or sub - contractor to
establish a good faith effort to fill all employment positions
with Section 3 Project Area residents.
(2) every applicant, recipient, contracting party, contractor,
sub - contractor to incorporate or cause to be incorporated
in all contracts for work in connection with a Section 3

(3) each applicant, recipient, contractor, sub - contractor
undertaking work on a Section 3 Covered Project to assure
that to the greatest extent feasible, contracts for work
or materials in connection with the project be awarded to
businesses in the Section 3 Area which are owned or sub-
stantially owned by persons residing in Section 3 Covered
Area.
(4) each applicant, recipient, contractor, or sub - contractor
undertaking work with Section 3 Covered Project that to the
greatest extent feasible, fulfill his obligation to utilize
lower income project area residents.
All departments of the City of Round Rock, Texas, will adhere to
requirements or objectives of this plan.

(G) James G. Samuelson, Jr., City Manager, is the person responsible
for the implementation of the Affirmative Action Plan.
EQUAL OPPORTUNITY CLAUSE
During the performance of this contract, the applicant agrees as follows:
A. The applicant will not discriminate against any employee or applicant
for employment because of race, color, religion, sex, or national
orgin. The applicant will take affirmative action to ensure that
applicants are employed, and that employees are treated during employ-
ment, without regard to their race, color, religion, sex, or national
origin. Such action shall include, but not be limited to the following:
Employment, upgrading, demotion, or transfer; recruitment or recruit-
ment advertising; layoff or termination; rates of pay or other forms
of compensation; and selection for training, including apprentice-
ship. The applicant agrees to post in conspicuous places, available
to employees and applicants for employment, notices to be provided
setting forth the provisions of this nondiscrimination clause.
B. The applicant will, in all solicitations or advertisements for em-
ployees placed by or on behalf of the applicant, state that all
qualified applicants will receive consideration for employment without
regard to race, color, religion, sex, or national origin.
C. The applicant.will send to each labor union or representative of
workers with which he has a collective bargaining agreement or other
contract or understanding, a notice to be provided by the Contract
Compliance Officer advising the said labor union or workers' repre-
sentatives of the applicant's commitment under this section, and
shall post copies of the notice in conspicuous places available to
employees and applicants for employment.
D, The applicant will comply with all provisions of Executive Order
11246 of September 24, 1965, and of the rules, regulations, and
relevant orders of the Secretary of Labor.
E. The applicant will furnish all information and reports required by
Executive Order 11246 of September, 24, 1965, and by rules, regulations
and orders of the Secretary of Labor, or ' pursuant thereto, and will
permit access to his books, records', and accounts by the Department
and the Secretary of Labor for purposes of investigation to ascertain
compliance with such rules, regulations, and others.
F.'`In the "event of the applicant's non-compliance with the non - discrimination
clauses of this contract or with any of the said rules, regulations,
or orders, this contract may be cancelled, terminated, or suspended
in whole or in part and the applicant may be declared ineligible for
further Government contracts in accordance with procedures authorized
in Executive Order 11246 of September 24, 1965, or by rule, regulation,
or order of the Secretary of Labor, or as otherwise provided by law.
G. The applicant will include the provisions of the sentence immediately
preceding paragraph "A" and the provisions of paragraphs "A" through
"G" in every sub - contract or purchase order unless exempted by rules,
regulations, or orders of the Secretary of Labor issued pursuant to
section 204 of Executive Order 11246 of September 24, 1965, so that
such provisions will be binding upon each sub - contractor or vendor.
The applicant will take such action with respect to any sub - contract
or purchase order as the Department may direct as a means of enforcing
such provisions, including sanctions for non - compliance: Provided,
however, that in the event an applicant becomes involved in, or is
threatened with, litigation with a sub - contractor or vendor as a
result of such direction by the Department, the contractor may request
the United States to enter into such litigation to protect the interest
of the United States.
