WHEREAS, the City Council of the City of Round Rock, Texas, is desirous of discouraging leap frog development while encouraging contiguous urban develop- WHEREAS, the City requires new development in the city limits and ETJ to be tied onto city services; and WHEREAS, it is the belief of the City Council that all new development on city services should share in paying city taxes; NOW, THEREFORE, be it resolved that the policy of the City of Round Rock requires all new development where possible to request annexation before city ser- vices may be tied onto. WHEREAS, on June 8, 1978, the City Council adopted Resolution No. 1688 which required "all new development where possible to request annexation before city services may be tied onto," and WHEREAS, since June of 1978, the City has been successful in substantially expanding the capacity of the water and wastewater systems, and WHEREAS, it is to the advantage of all of the City's utility ratepayers to have as many users as possible to share in the cost of the utility systems, and • WHEREAS, there exists certain areas, which are located very near the City limits but outside the City's extra- territorial jurisdiction (ETJ) which could be economically and efficiently served by the City's utility systems, and WHEREAS, the Council is willing to consider on a case - by -case basis, applications for utility services for areas near the City but outside its ETJ and therefore not subject to annexation, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS • That the policy of the City of Round Rock regarding the provision of water and wastewater services outside the city's limits is as follows: (1) The City will consider contracts with other governmental entities for wholesale or retail utility services on a case -by -case basis. (2) Developers or owners of properties that are within the City's ETJ must request voluntary annexation in order to receive City services. (3) The applications for service of developers or owners of properties located near the City but outside its ETJ will be considered on a case - by -case basis, and if found to be in the best interest of the citizens of the City, such applications will be granted.
