R-79-192 - 2/22/1979CONTRACT Agreement made this - day of �.- 1,b(,(,l,Q A.(t , 1979 between the City of Round Rock, Texas, hereinafter referred to as "City" and Williamson Burnet County Opportunities, Inc., a non - profit Texas Corporation, hereinafter referred to as the "Organization:" WHEREAS, the City plans to provide a Child Development Center for the underprivileged families of Round Rock, and WHEREAS, The Organization desires to operate the Child Develop- ment Center for the City; NOW THEREFORE, It is agreed as follows: The Organization agrees to provide the necessary staff and to operate the Child Development Center in Round Rock by providing day care and related services to the children of low- income families of Round Rock. II. The eligibility of the children to participate in the pro- gram shall be determined by the Organization according to the appropriate guidelines. III. The Organization agrees to operate the center from 7:30 o'clock A.M. to 4:00 o'clock P.M., Monday through Friday. IV. The term of this Contract shall be a one year period from May 1, 1979 to April 30, 1980. V. In consideration of the above services, City agrees to pay Organization $20,000.00 payable in twelve equal monthly in- stallments, the first installment being due on or before the tenth (10th) day of May, 1979 and a like installment being due on the same day of each subsequent month, the last in- stallment being due on April 10, 1980. City also agrees to provide any maintenance and utilities. VI. The Organization has attached a copy of its proposed budget to this Contract and any amendments to this budget must be approved by the City Council. VII. The obligations and undertakings of each of the parties to this agreement shall be performable at Round Rock, Williamson County, Texas. ATTEST; VIII. If any term provision, covenant, or condition of this agree- ment is held by a court of competent jurisdiction to be in- valid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. IX. This agreement shall be governed by and construed in accordance with the laws of the State of Texas Executed in duplicate on the dates indicated below.
