R-79-206 - 5/10/1979J WHEREAS, the City Council desires to investigate the possi- bilities of purchasing the present Farmers State Bank building and adjoining properties, and WHEREAS, an appraisal of the property is desirable in order to determine the fair market value of the property, and WHEREAS, Tom Wiley has proposed a contract for appraisal services, and WHEREAS, the City Council desires to enter into said contract with Tom Wiley, now therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS The Mayor is hereby authorized and directed to execute on behalf of the City a contract with Tom Wiley for an appraisal of the Farmers State Bank property, a copy of which contract is attached hereto and incorporated herein for all purposes. Wiley Co. and City.of We propose to make an appraisal of the above referenced property for you This appraisal assignment shall include an investigation and analysis of trends and activity in the market which are considered pertinent to the valuation of the Subject Property. We will furnish you with 3 copies of the completed appraisal report. The fee for these services will be $3,500. , payable as follows: 1. $1,000 as a retainer upon the signing of this agreement. 2. X $2,500 upon completion of the real estate appraisal re- port, as described above. Appraisal to be• completed on or before July 15, 1979. It is specifically understood that our fee is reasonable and is not in any way conditioned upon the resultant value expressed in the appraisal. • In the event that you or your Company desire to cancel this contract, written notice thereof shall be delivered to us, and it is agreed that we shall receive compensation from you or your Company for all services rendered at the rate of .$32 per day for the time actually spent prior to receipt of written notice to stop work plus any direct costs incurred. The charges shall be billed first against the retainer, and the balance due and payable to us. If any retainer balance remains, it shall be remitted to either you or your Company, as instructed. It is further understood that you personally guarantee the payment of our services and that you and your Company are jointly and severally liable for the fees set forth herein.
