COMMERCIAL LANDSCAPE CONTRACTORS
CONTRACT
WHEREAS, City of Round Rock, Round Rock, Texas, hereinafter known as the Owner,
does hereby contract with River Oaks Landscaping, Inc., P. 0. Drawer 1117,
Georgetown, Texas, hereinafter known as the Contractor, for furnishing certain
- materials and labor for manual irrigation system at Mesa Village Park, Round
Rock, Texas.
NOW, THEREFORE, the parties hereto have agreed and hereby do agree:

1. Contractor is to commence work within ten days of notification and further
agrees to complete work without delay other than delays caused by Acts of
God, strikes or other conditions beyond its control.
2. Contractor agrees to furnish Certificates of Insurance indicating sufficient
workmen!s compensation, public liability and any other insurance as may be
required to protect himself and Owner, and submit insurance certificates
reflecting current coverages before any onsite labor is performed.
3. The Contractor agrees to hold the Owner harmless from any and all liens and
all claims of persons furnishing material, labor or appliance in connection
with this contract. Should the Contractor fail to promptly pay when due,
all labor, payroll, freight, express or material bills which failure would
cause the Owner, at his option, to advance funds to cover same; then a
charge of ten percent (102) will be made for this service rendered.
4. Contractor agreea to pay all federal, state and local taxes of every nature
required by such agencies and Owner assumes no liability for collection
or payment.
5. Contractor is to remove all debris and trash caused by him or his workmen
to a designated area or areas on the jobsite. -
6. It is understood and agreed that all incidental materials and /or labor as
may be required by the plans, specifications and written agreements to
make the work complete in every respect are included in this contract.
7. Under this contract, the Contractor acknowledges and agrees that he has
the sole responsibility for compliance with all the requirements of the
Occupational Safety and Health Act of 1970, as amended, and agrees to in-
demnify and hold harmless the Owner against any legal liability or loss.
THE LABOR AND MATERIALS INCLUDED IN THE CONTRACT IS:
Furnish the necessary labor and materials to install a manual irrigation
system at Mesa Village Park, Round Rock, Texas, according to the plans and
specifications as attached.
This is a tax exempt project, with Exemption Certificate attached.
The Owner agrees to pay the Contractor for the faithful performance of this
contract the total sum of Three Thousand One Hundred and Seventy Dollars
and No Cents ($3,170.00).
The Owner agrees to pay the Contractor in full within tea (10) days following
completion of this contract.

CONTRACTOR'S GUARANTEE
River Oaks Landscaping, Inc. (Contractor) agrees that
during a period of one year from and after final acceptance
of the sprinkler system ' constructed at Mesa Village
Park in Round Rock, Williamson County, Texas, the Con-
tractor shall, at its own expense, make all needed repairs or
replacements due to defective workmanship or materials which,
in the judgment of the City Engineer, shall become necessary
during such period. If within ten (10) days after the mailing
of a written notice by the City Manager to the Contractor, or
his agent, requesting such repairs or replacement, the Con-
tractor shall neglect to make or undertake with due diligence
to make the same, the City may make such repairs at the
Contractor's expense; provided however, that in the case of
emergency where, in the judgment of the City Engineer, delay
would cause serious loss or damage, repairs or replacement
may be made without notice being sent to the Contractor, and
the Contractor shall pay the cost thereof.

WHEREAS, the City Council of the City of Round Rock, as a matter of policy
awards bides to the lowest and best responsible bidder, and
WHEREAS, River Oaks Landscaping submitted the lowest and best bid for a
sprinkler system for Mesa Village Park, and
WHEREAS, the City Council of the City of Round Rock awarded the bid to
the above said company at the December 17, 1979 meeting,
NOW THEREFORE, BE IT RESOLVED by the Council of the City of Round Rock,
Texas that
The Mayor be authorized to execute a contract with River Oaks Landscaping
Co. for a sprinkler system for Mesa Village Park.
RESOLVED this 27th day of December, 1979.
