BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS

execute on behalf of the City a contract with the University
of Texas Memorial Museum, a copy of said contract being
attached hereto and incorporated herein for all purposes.

Agreement made this
CONTRACT
day of , 1980,
by and between the City of Round Rock, Texas, hereinafter
referred to as City, and the University of Texas at Austin,
by and through the Texas Memorial Museum, hereinafter
referred to as the University.
Purpose of Agreement
The purpose of this Agreement is to state the terms and
conditions under which the University will provide preservation
and restoration services in connection with an old stone marker
recently discovered in the path of a proposed water line along
Chisholm Trail Road in Round Rock, Texas.
Now Therefore, in consideration of the mututal promises
herein contained, the parties hereto agree to as follows:
Services To Be Performed
The University agrees to perform the following services in
connection with the stone marker:
1. Remove the marker and any and all related
materials prior to the start of construction
of the water line or by September 15, 1980,
whichever is later;
2. Protect, preserve and restore the marker in
the Museum Laboratory; and
3. Replace the marker in or as near its original
location as possible after the construction
is completed.
Compliance With Applicable
Federal Regulations
In performing the services required of it under this
Agreement, The University shall comply with all applicable
federal statues and regulations concerning the federal grant
under which the water line is being constructed. If such
compliance is impossible for reasons beyond its control, The
University shall immediately notify the City of that fact and
the reasons therefor.
Compensation
The City shall pay The University One Thousand, Four
Hundred and No /100 Dollars ($1,400.00) for the services
herein agreed to be performed. Payment in full shall be
made within thirty (30) days of the date the marker is
replaced in its original location.
Miscellaneous Provisions
Texas Law To Apply: This Agreement shall be construed
under and in accordance with the laws of the State of Texas,
and all obligations of the parties created hereunder are
performable in Williamson County, Texas.
Parties Bound: This Agreement shall be binding upon and
inure to the benefit of the parties hereto and their respective
legal representatives, successors and assigns.
Prior Agreements Superseded: This Agreement constitutes
the sole and only agreement of the parties hereto and super-
sedes any prior understandings or written or oral agreements
between the parties respecting the within subject matter.
Executed in duplicate originals on the day and year
first above written.
