RESOLVED this 4/7-'day of Dec er, 1980 Ii�_s - ►pis.,._ , .w ' ONN, Mayor City of Round Rock, Texas 78664 AGREEMENT WHEREAS, the concept of community education is unique with unlimited potential, and WHEREAS, the consolidation by various public authorities of their respective _resources and expertise will minimize e - duplication of facilities, staff and programs, and WHEREAS, the City of Round Rock and the Round Rock Independent School District wish to cooperate to provide the best possible program for Community Education for the citi- zens of Round Rock, NOW THEREFORE, it is agreed by the undersigned parties as follows: I. Program Administration The Round Rock Independent School District shall be responsible for the administration of the community education program and shall employ a Campus Director to facilitate the operation and management of the total program. Additionally, the City of Round Rock will provide administrative assistance through the services of designated city staff member(s). The Round Rock Independent School District shall employ all instructors for such courses as may be offered through the community education program and shall be responsible for the compensation of such instructors through the school busi- ness office. The instructors shall be under the supervision and direction of the Campus Director and subject to all rules and regulations pertaining to employees of the district. The Round Rock Independent School District shall main- tain such records of programs and financial management as may be required to meet the audit requirements of the State of Texas. In order to facilitate coordination efforts and program development, there shall be established a Program Steering Committee which shall be composed of the Campus Director, one member appointed by the Mayor of the City of Round Rock, one member appointed by the Superintendent of Schools and two members appointed by the advisory council. The Steering Com- mittee shall meet monthly to plan future programs and to monitor the operation of the total program. The Steering Committee shall make such recommendations to the Round Rock Community School Advisory Council as may be appropriate to assure the adequacy of the program and efficiency of opera- tion. The Round Rock Advisory Council shall then make such recommendations as may be required to the Superintendent of Schools and /or the City Manager of the City of Round Rock. II. Financial Responsibilities The Round Rock Independent School District shall be responsible for the financial management of the program in accordance with the regulations and procedures established by the Texas Education Agency. All monies collected for course tuition will be collected and deposited by the district and all approved expenditures for program operation will be paid through the school business office. The Round Rock Independent School District shall make special efforts to secure supplemental funding for the commu- nity education program from appropriate federal, state, and private agencies to defray the administrative costs of the program. The City of Round Rock will provide financial sup- port for the designated city staff member(s) mentioned above. The Program Steering Committee will develop for each session an amount to be charged against tuition receipts to help defray costs for maintenance, utilities, and housekeeping. III. Use of Facilities The Round Rock Independent School District shall desig- nate the school facilities to be used by the Round Rock - 2 - Community School and program activities shall be limited to those designated facilities. Only those courses and activi- ties published in the official program schedule of the Round Rock Community School shall be considered a part of the program and provided free use of the school facilities desig- nated. It is understood that the City of Round Rock Parks and Recreation Department may offer courses or activities inde- pendently of the Round Rock Community School program. How- ever, it is clearly understood that when such independent courses or activities are proposed to be offered in school facilities the City of Round Rock Parks and Recreation Depart- ment shall follow the procedures established by the district for the negotiation of a facilities use contract and shall assume full responsibility for the supervision of the use of such facilities. IV. Termination of Agreement This agreement may be terminated by either the Round Rock Independent School District Board of Trustees or the Round Rock City Council sixty (60) days after delivery of notice in writing of its intention to the other party. Should either the'Round Rock I District or the City, of Round Rock fail,to perform under the terms of this agreement or comply with its terms, either party may terminate the agreement thirty (30) days after delivery of notice to the other party of its intention to terminate this agreement for cause. Every effort will be made to coordinate the efforts and pro- gram development no that duplication will be kept to a minimum. Each party will bear the responsibility of maintaining its own records. However, statistical data will be jointly obtained' in many cases and will be made accessible to each party at all reasonable times. II. Financial Money collected for course tuition will be credited and paid ' to the party offering the specific course. Although each party will bear the expense of paying its own instructor and support staff, if any, the parties may agree in the future to share the compensation paid to the Community Schools Coordinator. III. Maintenance and Operating Costs Each party will be responsible for the maintenance and operating costs of their respective facilities and equipment. 77 7 1 1 1 1 1 IV. Facilities The specific course and /or activity will determine the type of facility used. Both parties will have reasonable access to available facilities of each party. V. Supplies and Equipment The parties will cooperate in the use of necessary supplies as available. Expended supplies and equipment will be purchased by the party offering the specific course requiring the supplies or equipment. VI. Storage Space The parties will cooperate in the providing of storage space to each other. The instructors will be encouraged to store supplies in an off -site area when at all possible.
