WHEREAS, the Round Rock Independent School District and the City of Round
Rock wish to share the cost of assessing and collecting taxes, and
WHEREAS, the Round Rock Independent School District has submitted a contract
to the City for its approval, and
WHEREAS, the Council of the City of Round Rock wishes to enter into said
contract with the Round Rock Independent School District, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS:
That the Mayor is hereby authorized and directed to execute on behalf of the
City, a contract with the Round Rock Independent School District which provides
for the sharing of tax assessing and collection costs; a copy of said contract
is attached hereto and made a part hereof for all purposes.

Prbposed Contract
WHEREAS the City of Round Rock, Texas, duly authorized thereto by the
provisions of TEX. REV. CIV. STAT. ANN. art. 1066b (1963) and §10.08 of
the Round Rock City Charter, has by resolution duly adopted authorized the
Tax Assessor, Board of Equalization, and Tax Collector of the Round Rock Inde-
pendent School District to act as Tax Assessor, Board of Equalization,
and Tax Collector respectively for the City of Round Rock, Texas, and
WHEREAS the Round Rock Independent School District has agreed that
its Tax Assessor, Board of Equalization, and Tax Collector may act as the
Tax Assessor, Board of Equalization, and Tax Collector respectively for
the City of Round Rock, Texas,
NOW, THEREFORE, for and in consideration of the hereinafter stated
promises and agreements the following contract and agreement is entered
into by and between the City of Round Rock, Texas, A Texas municipal corpo-
ration, hereinafter called the City, and the Round Rock Independent School
District, an independent school district duly organized and existing under the
laws of the State of Texas, hereinafter called the School District, as follows:
Section 1. Term of Contract
This contract shall be effective from February 1,1981to August 31, 1982
Section 2. Applicable Laws
In order that the School District may levy, assess, and collect the taxes
of the City in a uniform and economical manner, the City agrees to adopt
by resolution or ordinance as provided in TEX. REV. CIV. STAT. ANN. art.
1066b §la (1963) all of the laws of the State of Texas applicable to the levy,
assessment, and collection of taxes by the School District including the
provisons of Title 122 which govern the County Board of Equalization.
Section 3. Tax Assessor and Tax Collectdr
The School District shall determine the qualifications of the Tax Assessor
and Tax Collector and shall appoint the Tax Assessor and Tax Collector.
At the School District's discretion the same individual may serve as both
Tax Assessor and as Tax Collector.
Section 4. Board of Equalization
The City recognizes that School District has contracted for appraisal ser-
vices with the Williamson County Appraisal District and with Truett Prit-
chard and Associates. The same values developed for the School District and
equalized by the School District Board of Equalization shall be used by the
City for ad valorem tax purposes. The Board of Equalization of the School
District shall serve as the Board of Equalization of the City and its duties
for both the City and the School District shall be performed concurrently
without the necessity of holding separate hearings for property owners in the
City and in the School District. City recognizes that the Williamson County
Appraisal District shall appoint from a list recommended by the School Dis-
trict three residents of the School District to serve as the School District
Board of Equalization. The City agrees to these appointment procedures and
qualifications for individuals serving as the School District and City
Board of Equalization. The City recognizes that the Williamson County App-
raisal District Board of Equalization serves as the Board of Equalization
of the School District and has the power and must perform the duties of the
County Board of Equalization as provided by Title 122 of the Texas Revised
Civil Statutes, 1925, as amended. Therefore the Board of Equalization of the
City is the Williamson County Appraisal District Board of Equalization. For the
purposes of the City Board of Equalization, the City agrees to adopt the pro-
visions of Title 122 governing the County Board of Equalization.
Section 5. Tax Rate
After the tax rolls have been prepared and approved, the Tax Assessor shall
calculate and publish the effective tax rate as required by TEX. REV. CIV.
STAT. ANN. art. 7244c. The City shall determine and fix the tax rate to be
applied to the property values for City taxes and shall inform the Tax Asses-
sor of the School District as to such determination by the City.
Section 6. Tax Collection
The Tax Collector shall mail tax notices to property owners whose property
has been assessed for taxes and shall thereafter collect such taxes as may
be paid. The Tax Collector shall pay over to the depository of the City
such taxes as may be collected as they are collected and shall perform other
duties of a tax collector for the city. The Tax Collector shall furnish
such tax certificates as may be required by law covering taxes due both the
City and the School District to those applying for such certificates as are
permitted by law. In the event it becomes necessary to file suits for the col-
lection of delinquent taxes due the City and the School District, the City
shall be responsible for taking the necessary action to file and prosecute
such suits for the collection of the City taxes and the School District shall

Section 7. Payments
The City shall pay the School District a fee which shall be a percentage of
the Tax Office Budget for expenditures. This percentage is to be based on
a comparison of total market value of properties on the City Tax Roll to
market value of properties on the School Tax Roll with payment not to exceed
$ 65638 for services to be performed by the Tax Assessor, Board of Equalization,
and Tax Collector of the School District, one -half of which shall be due and
payable on or before .March 1, 1982 , and the remaining one -half of
which shall be due and payable on or before June 1, 1982

Section 8. Confidentiality
City agrees to honor the agreement between L.R.I.S., Inc. and Appraisal
District regarding the confidentiality of trade secrets and L.R.I.S., Inc.
material protected by trade -mark, patent, copyright laws and rulings.
A copy of this agreement is attached to this contract and made a part hereof
for all purposes.
Section 9. Tax Records
Upon the termination of this contract for any reason the City shall be en-
titled to have such tax records of the School District's tax department
reproduced as may be desired by officials of the City. Such reproduction
shall be furnished by the School District to the City with reasonable dili-
gence and the City shall pay to the School District the cost of such re-
production. Appropriate officials of the City shall have access to the tax
records of the School District during the period of this contract at rea-
sonable times during normal office hours.
Section 10. Subcontracting
The School District may subcontract with any person or entity to provide
any of the services to be provided by the School District pursuant to this
contract.
Section 11. Time of Essence
Time is of the essence of this contract.
Section 12. Severability
If any obligation or covenant of either party hereto shall ever be held in-
valid, the remaining provisions of this contract shall continue to be binding
and enforceable.

Execution of the contract constitutes ratification of the effective
dates set out herein above. This agreement is signed and executed this

During the term of this Contract and any extension hereof,
DISTRICT will have access to and become familiar with various
LRIS trade secrets, and will have access to and become familiar
with LRIS material protected by trademark, patent, and copyright
laws and rulings, including but not limited to formulas,
patterns, devices, secret inventions, processes, and compilations
of information, records, and specifications which are owned or
controlled by LRIS. The DISTRICT shall not disclose any of the
aforesaid information (referred to in the aggregate as 'trade
secrets') which includes Exhibit 'A' attached hereto, directly or
indirectly, nor shall it use such trade secrets in any way,
either during the term of this Contract or at any time
thereafter, except as provided by this Contract. The prohibitions
of this Paragraph XI. shall apply to all DISTRICT employees,
consultants, and professional advisers, and to anyone else who
ever has access to LRIS's trade secrets because of his
association with DISTRICT.
