THIS AGREEMENT, made this 11 day of June , 1982, by and
between the City of Round Rock, Texas, hereinafter called the "City ", Party
of the First Part, acting by and through its City Council and the State of
Texas, hereinafter called the "State ", Party of the Second Part, acting by
and through its State Highway and Public Transportation Commission.
WHEREAS, the City desires the construction of East Frontage Road and
incidental items within the limits from Loop 384, south to U. S. Highway No.
79 in Round Rock on Interstate Highway No. 35 and the State will, among other
things, provide for the construction of this work within these limits and the
City will contribute a fixed amount of One Hundred Seventy Five Thousand and
No /100 Dollars ($175,000.00), in payment for their portion of this work, and
WHEREAS, the City by the execution of this agreement agrees to the terms
and conditions of Commission Minute No 78763, as it applies to the City, a
copy of which is attached hereto and marked "Exhibit A" and made a part of
this agreement.
NOW THEREFORE, it is understood that this proposed work will be con-
structed by the State and the City will transmit to the State with the return
of this agreement, executed by the City, a warrant or check made payable to
the State Treasurer, Account of Trust Fund No. 927 in the amount of One Hundred
Seventy Five Thousand and No /100 Dollars ($175,000.00). It is further understood
that the State will construct only those items for the City as requested and it
is further understood that the contribution of One Hundred Seventy Five Thousand

and No /100 Dollars ($175,000.00), by the City shall be a fixed amount for
their share of the work. It is further understood that the City by the ex-
ecution of this agreement agrees to the terms and conditions of Commission
Minute No. 78763, as it applies to the City, a copy of which is attached
hereto and marked "Exhibit A" and made a part of this agreement.
IN TESTIMONY WHEREOF, the parties hereto have caused these presents to
be executed in duplicate on the day above stated.

As identified in our letter of March 12, 1982, the Agreement providing
for the joint funding of the subject project has now been prepared and
forwarded to us by our Main Office Finance Division.
Please arrange for appropriate approval and execution of both the
attached Agreement original and duplicate original, and return both
copies to us with the required check or warrant in the amount of
$175,000., made payable to the State Treasurer, Account of Trust Fund
No. 927. Also, please submit an attested or certified Council Resolu-
tion concurring with construction completion on the one -way frontage
road operations between Sunset Drive and the Loop 384 interchange.
On final execution of the Agreement by our Department Administration, the
duplicate original will be returned for your files.

WHEREAS, the City of Round Rock, desires the construc-
tion of the East Frontage Road and incidental items from Loop
384, south to U.S. Highway 79 on Interstate Highway No. 35,
WHEREAS, the State of Texas, acting by and through its
State Highway and Public Transportation Commission will
provide the construction of said improvements, and
WHEREAS, the City's contribution towards the cost of
said improvements is a'fixed amount of One Hundred Seventy -
Five Thousand and No /100 Dollars ($175,000.00), and
WHEREAS, the City Council wishes to enter into an agree-
ment with the State Highway and Public Transportation
Commission, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS
That the Mayor is hereby authorized and directed to
execute on behalf of the City an agreement with the State
Highway and Public Transportation Commission, a copy of said
agreement being attached hereto and incorporated herein for
all purposes, and
BE IT FURTHER RESOLVED
That when the funds are available from the sale of
Certificates of Obligation, the disbursement of $175,000.00
for the City's share of the construction costs is hereby
authorized and approved.
