AGREEMENT made this /et' day of

between the City of Round Rock, a Texas municipal corpora-
tion, hereinafter referred to as "City" and William B. La
Londe, Inc., a Texas corporation, hereinafter referred to as
"La Londe ".
Recitals
The City has adopted the Southern Standard Building Code
(Code) and pursuant to said Code has the responsibility and
authority to inspect all construction in the City to insure
compliance with the Code.
The City desires to engage the services of La Londe to
assist in the required building inspection and to render its
services on the terms and conditions provided in this
agreement.
La Londe is engaged in the business of providing
professional inspection services, and desires to render its
professional services for the City as provided herein.
THEREFORE, the City hereby engages the services of La
Londe, and in consideration of the mutual promises herein
contained, the parties agree as follows:
Term
1. The agreement shall be for a period of one (1) year,
commencing on March 10, 1983, and may be terminated by either
party by giving sixty (60) days written notice to the other
party.
Services
2. La Londe agrees to perform all building inspections
required by the Code for new construction of single - family
homes, duplexes, tri- plexes, and four - plexes. The inspections
to be performed are as follows:
1st Inspection - Temporary Loop to be called in by
the electrician.
Items to be checked include:
1. Bracing of pole
2. Grounding
3. Outlet and wire size, breaker size
4. GFCI protection
5. Missing knockouts, weatherproof outlets
2nd Inspection - Plumbing Rough called by the
plumber and layout inspection called by the builder.
Items to be checked include:
1. Leaks - water test of draws and vents
2. Proper venting
3. Type and size of pipe
4. Proper grade, bedding and backfill
5. Location of building on lot
3rd Inspection - Copper Inspection called by
plumber to be combined with foundation inspection
or Plumbing Rough whenever possible.
Items to be checked include:
1. Pipe size and type
2. Proper bends
3. Joints above grade
4. Visible damage
5. Isolation from dissimilar metals
4th Inspection - Foundation inspection called by
Building Superintendent.
Items to be checked include:
1. Correct beam depth and width
2. Correct size and spacing of steel
3. Proper bracing of forms
4. Proper lapping of steel
5. Continuous vapor barrier
6. Copper separation from steel
5th Inspection - To be called by Building Superin-
tendent prior to insulation to include framing,
electrical plumbing and mechanical. Also gas and
water test and sewer tap to be done at the same
time if possible.
Framing Inspection to include:
1. Nailing requirements for siding, sheathing
and roof decking.
2. Bracing of walls gables, etc. . . .
3. Scuttle hole size and location
4. Thirty pound plate felt between bottom plate
and concrete
5. Proper grading of lumber and plywood
6. Proper spans and bracing of rafters, joists
and beams

7. Correct window size in bedrooms
8. Proper fireplace installation and clearance
9. Proper header size
10. Sheetrock nailers
11. Fireblocking at furrdowns, etc. . . .
Electrical Inspection to include
1. Check number of outlets and spacing of outlets
2. Check for GFCI circuit, bathrooms, garage and
W/P outlets
3. Number of outlets in relation to wire size
4. Laundry outlet
5. Correct type of feeder wire
6. Garage outlets and outside outlets as required
7. No wiring across scuttle hole
8. Check proper installation of sub -panel box
Plumbing Topout Inspection to include:
1. Check gas pipe installation and pressure test
if ready
2. Check tubs set and connected and shower
stalls installation
3. Inspection shower pan
4. Check for proper strapping of pipe
5. Separation of copper and dissimilar metals
6. Check for required cleanouts
7. Proper venting and flashing
8. Check air chambers where required
Mechanical Inspection to include:
1. Proper installation of Ducts
2. Proper outlets, size, material fastening and
lapping of joints
3. Proper insulation of ducts
4. Access and work space to attic unit
5. Proper size clearance of flue vents from
combustibles
6th Inspection - Insulation called by Building
Superintendent.
Inspection to include the following:
1. Check to see if insulation installed properly
2. Check for proper "R" valves at ceilings and
exterior walls
7th Inspection - Final to be called by Building
Superintendent.
Items to be checked include:
1. Check finished yard for proper drainage,
minimum slab height above finished ground level
2. Check A/C for above grade level
3. Check water meter box for proper height and
clearance
4. Inspect for vaccum breaker. Installation on
all hose bibbs
5. Check outside weather proof outlets for seal
6. Check for maximum of six disconnects at
electrical panel
7. Check for GFCI installation

8. Check attic insulation
9. Inspect proper bonding or service equipment
10. Check site for removal of construction debris
11. Check for smoke detectors at proper locations
12. Check for required combustion air for gas
appliances
13. Check fireplace and hearth for compliance
with code
14. Check for A/C disconnects where required.
Switch at furnace.
15. Check caulking of bathroom fixtures
Sewer Tap and Gas test will be combined with other
inspections whenever possible. If La Londe is
unable to complete these in combination with other
inspections they will be made without charge.
The foregoing inspections will be combined whenever
possible.
The items inspected may be amended from time to time by
the Southern Building Code Congress or by ordinance adopted
by the City Council.
La Londe agrees to make all inspections in a prompt
manner. All inspections requested by 10:00 o'clock a.m. will
be performed the same day. Inspections called in after 10:00
o'clock a.m. will be done the same day if the work load
permits. La Londe will provide the City with direct communica-
tion capability with the inspector(s) through the use of
mobile radio or other means.
Fees
3. For services to be rendered under this contract, La
Londe shall be entitled to a fee of $20.00 for each
inspection performed up to 200 inspections per month. For
inspections from 201 to 400, the fee shall be $15.00 per
inspection. For inspections 401 and greater, the fee shall be
$10.00 per inspection. Re- inspection fees at a rate of $10.00
per inspection shall be collected by La Londe from the
respective builder. Sewer tap and gas test inspections will
be made at no additional charge. La Londe will bill the City
on or before the last day of each month and payment will be
made by the fifteenth of the following month.

Insurance
4. La Londe shall be an independent contractor and not
an employee of the City under this agreement and shall
maintain a policy of liability insurance in the minimum
amount of $100,000.00 for property damage and $500,000.00 for
bodily injury, to cover any claims arising out of the
performance of its services under this agreement.
Indemnity
5. La Londe agrees and undertakes to indemnify the City
from any and all liability, loss, or damage the City may
suffer as a result of claims, demands, costs, attorney's
fees, or judgments against it arising out of the performance
of its services under this agreement.
Entire Agreement
6. This agreement supersedes any and all other agree-
ments, either oral or in writing, between the parties hereto
with respect to the subject matter hereof, and no other
agreement, statement, or promise relating to the subject
matter of this agreement which is not contained herein shall
be valid or binding.
Assignment
7. Neither this agreement nor any duties or obligations
hereunder shall be assignable by La Londe without the prior
written consent of the City. In the event of an assignment by
La Londe to which the City has consented, the assignee or his
legal representative shall agree in writing with the City to
personally assume, perform, and be bound by the covenants,
obligations, and agreements contained herein.
Successors and Assigns
8. Subject to the provision regarding assignment, this
agreement shall be binding on the heirs, executors,
administrators, legal representatives, successors, and
assigns of the respective parties.

Attorney's Fees
9. If any action at law or in equity is brought to
enforce or interpret the provisions of this agreement, the
prevailing party shall be entitled to reasonable attorney's
fees in addition to any other relief to which he may be
entitled.
Governing Law
10. The validity of this agreement and of any of its
terms or provisions, as well as the rights and duties of the
parties hereunder, shall be governed by the laws of the State
of Texas, and all obligations created hereunder are perform-
able in Williamson County, Texas.
Amendment
11. This agreement may be amended by the mutual agreement
of the parties hereto in a writing to be attached to and
incorporated into this agreement.
Legal Construction
12. In case any one or more of the provisions contained
in this agreement shall for any reason be held to be invalid,
illegal, or unenforceable in any respect, such invalidity,
illegality, or unenforceability shall not affect any other
provision thereof and this agreement shall be construed as if
such invalid, illegal, or unenforceable provision had never
been contained herein.
EXECUTED at Round Rock, Texas, on the day and year first
above written.

WHEREAS, the City of Round Rock has for the past year
contracted with William B. LaLonde, Inc. to provide profes-
sional building inspector services for the City, and
WHEREAS, the City Council wishes to renew the contract
with William B. LaLonde, Inc., for an additional year, Now
Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS, THAT
The Mayor is hereby authorized and directed to execute
on behalf of the City a contract to provide residential
building inspection services with William B. LaLonde, Inc., a
copy of said contract being attached hereto and incorporated
herein for all purposes.
