R-83-518 - 5/12/1983ATTEST: RESOLUTION NO._ WHEREAS, there exists a need in the City of Round Rock for a child day care facility for underprivileged families, and WHEREAS, the Williamson- Burnet County Opportunities, Inc., proposes to contract with the City to provide the necessary staff to operate such a facility, and WHEREAS, the City Council wishes to enter into this contract with Williamson- Burnet County Opportunities, Inc., NOW THEREFORE BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS THAT: The Mayor of the City of Round Rock is hereby authorized and directed to execute on behalf of the City, a contract with the Williamson- Burnet County Opportunities, Inc., a copy of which is attached hereto as an exhibit. This means: Center enrollment will be increased from 30 to 35 eligible children and the age range changed from 2 to 5 years instead of 3 to 5 years. An additional staff member will be needed. Hours of operation are changing from 7 :30 a. m. to 5:30 p. m. to 7 :00 a. m. to 6:00 p. m. This will mean the Center Director and teaching staff will occasionally work overtime, so the budget for payment of overtime has been increased. CONTRACT Agreement made this a TN day of //key_ , 1983, between the City of Round Rock, Texas, hereinafter referred to as "City" and Williamson- Burnet County Opportunities, Inc., a non - profit Texas Corporation, hereinafter referred to as the "Organization ": WHEREAS, the City plans to provide a Child Development Center for the underprivileged families of Round Rock, and WHEREAS, the Organization desires to operate the Child Development Center for the City: NOW THEREFORE, It is agreed as follows: The Organization agrees to provide the necessary staff and to operate the Child Development Center in Round Rock by providing day care and related services to the children of low- income families of Round Rock. I I. The eligibility of the children to participate in the progrz.m shall be determined by the Organization according to the appropriate guidelines. III. The Orcanization agrees to operate the Center from 7 :00 o'clock A. M. to 6 :00 o'clock P. M. , Monday through Friday. I V. The term of this Contract shall be a one year period from May 1, 1983 to April 30, 1984. V. In consideration of the above services, City agrees to pay Organization $ 11,456.00 payable in twelve equal monthly installments, the first installment being due on or before the tenth (10th) day of May, 1983, and a like installment being due on the same day of each subsequent month, the last installment being due on April 10, 1984. Organization agrees to use $1,000.00 of the $11,456.00 for minor, routine maintenance of the building, grounds and equipment. In addition to the $11,456.00, City will make direct payment of Center utility bills. Contract Page Z• V I. The Organization has attached a copy of its proposed budget to this Contract and any amendments to this budget must be approved by the City Council. VII. The obligations and undertakings of each of the parties to this Agreement shall be performable at Round Rock, Williamson County, Texas. VIII. If any term provision, covenant, or condition of this Agreement is held by a court of competent jurisdiction to be invalid, void, or unenforceable, the remainder of the provisions shall remain in full force and effect and shall in no way be affected, impaired, or invalidated. I X. This Agreement shall be goverened by and construed in accordance with the laws of the State of Texas. Executed in duplicate on the dates indicated below.
