WHEREAS, the City Council wishes to retain the law firm
of Longley and Maxwell upon the terms and conditions of the
letter agreement submitted by said firm, Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS
That the Mayor of the City of Round Rock, Texas, is
hereby authorized and directed to execute on behalf of the
City, the retainer agreement set forth in the letter from
Phil Maxwell, a copy of said retainer agreement being
attached hereto and incorporated herein for all purposes.

This letter is to set forth the agreement governing our legal
representation of the City of Round Rock with regard to any claims
or causes of action it may have for the damages sustained by the
City resulting from the defective design or construction of sewer
lines, water lines, streets, and drainage facilities in the Round
Rock West Subdivision. This agreement replaces our agreement
dated August 12, 1982.
Attorney time will be billed to the City at the rate of
$100.00 per hour. Law clerk time will be billed at the rate of
$30.00 per hour. We will require a $2,500.00 non - refundable
retainer that will establish a credit against which attorney and
law clerk time will be billed at the foregoing hourly rates. Once
this credit is exhausted, the City will be billed monthly for
attorney and law clerk fees.
I.n addition, the City of Round Rock assigns to Longley &
Maxwell twenty -five percent (25 %) of any monies or property
obtained through settlement or litigation of the above claims and
causes of action.
The City will be responsible for all expenses we incur in
this representation.
The City will be billed monthly and all bills will be due
upon receipt.
The City authorizes Longley & Maxwell to take whatever action
said attorneys believe is necessary to recover the damages
referred to above. No compromise of the City's claims will be
made, however, without the City's approval.

If the City agrees to this proposal, please have an

this letter to us along with the City's check in the amount of
$2,500.00.
