WHEREAS, the City Council wishes to convey a 0.1904 acre
tract of land to Bert Hall and wife, Tyndel L. Hall in
exchange for a sanitary sewer easement to be conveyed to the
City, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
That the Mayor is hereby authorized and directed to
execute on behalf of the City a Warranty Deed for 0.1904
acres to Bert Hall and wife, Lyndel L. Hall.

That the City of Round Rock, a municipality, of the County
of Williamson and State of Texas for and in consideration of
the sum of TEN AND NO /100 DOLLARS ($10.00), conveyance of a public
utility easement by Bert Hall and Wife Lyndel L. Hall to the
City of Round Rock, and other valuable consideration to the under-
signed paid by the Grantee herein named, the receipt of which
is hereby acknowledged, have GRANTED, SOLD and CONVEYED, and
by these presents do GRANT, SELL AND CONVEY unto Bert Hall and
Wife Lyndel L. Hall of all of the following described real property
in Williamson County, Texas, to -wit:
FIELD NOTES describing a 0.1904 acre tract or parcel of
land, out of the Wiley Harris Survey, Abstract No. 298,
situated in the City of Round Rock, Williamson County, Texas,
being a portion of that certain 0.5 acre tract conveyed
to the City of Round Rock, Texas, by deed recorded in Volume
271, Page 526, of the Deed Records of Williamson County,
Texas, and being more particularly described by metes and
bounds as follows:
BEGINNING at a point being the northeast corner of said
0.5 acre tract, being an ell corner of that certain 6.83
acre tract conveyed to Bert Hall, et. ux., by deed recorded
in Volume 606, Page 667, of the Deed Records of said County,
also being in the south line of the remainder of those certain
lands conveyed to the Missouri- Pacific Railroad Company
be deed recorded in Volume 22, Page 441, of said Deed Records,
for the northeast corner and POINT OF BEGINNING of the herein-
after described 0.1904 acre tract;
THENCE, along the east line of said 0.5 acre tract, for
the east line hereof, S 19° 47' E, 54.04 feet to a point
in Lake Creek, being the southeast corner of said 0.5 acre
tract, for the southeast corner hereof;
THENCE, along the south line of said 0.5 acre tract, for
the south line hereof, S 70° 13' W, 168.82 feet to an angle
point in a fence line, for the southeast corner hereof;
THENCE, along the west line hereof, as fenced, the following
two (2) courses:
1. N 41° 09' E, 29.90 feet to an angle point in said fence,
for an angle point hereof;
2. N 19° 34' W, 45.09 feet to a fence corner post, being
the southeast corner of that certain 0.317 acre
(100' X 136') tract conveyed to the City of Round Rock,
for the northwest corner hereof;
THENCE, along a south line of said Missouri - Pacific Railroad
Company Tract, for the north line hereof, as fenced, N 72°
27' 30" E, 142.63 feet to the POINT OF BEGINNING of the
herein described tract, containing 0.1904 acres (8295 sq.
ft.) of land, more or less.
This conveyance is made and accepted subject to any and
all conditions and restrictions, if any, relating to the herein -
above described property, to the extent, and only to the extent,
that the same may still be in force and effect, shown of record
in the office of the County Clerk of Williamson County, Texas.

COUNTY OF WILLIAMSON §
That Bert Hall and Wife Lyndel L. Hall herein called Grantor
(whether one or more), for good and valuable consideration
paid by the City of Round Rock, Texas, 214 E. Main, Round Rock,
Texas, a municipal corporation, herein called Grantee, receipt
of which consideration is hereby acknowledged, does hereby GRANT,
SELL, AND CONVEY unto Grantee an easement and right -of -way upon
and across the following described property of Grantor:
All that certain tract, piece or parcel of land, lying and
being situated in the County of Williamson, State of Texas
described in EXHIBIT "A" attached hereto and made a part
hereof for all purposes, to which reference is here made
for more particular description of said property.
The right -of -way, easement, rights, and privileges herein
granted shall be used for the purpose of placing, constructing,
operating, enlarging, repairing, maintaining, rebuilding, replac-
ing, relocating and removing water lines, sewer lines, and any
and all other public utilities deemed necessary by Grantee, to-
gether with all necessary conduits, valves, vaults, manholes,
ventilators and appurtenances.
TO HAVE AND TO HOLD the above described easement and right-
of-way in and to said premises with the right of ingress and
egress thereto, together with all and singular the usual rights
thereto in anywise belonging, unto the City of Round Rock and
its successors and assigns forever. And Grantor does hereby bind
its executors, administrators and assigns to WARRANT AND FOREVER
DEFEND, all and singular, the said premises unto the City of
Round Rock, its successors and assigns, against every person
whomsoever lawfully claiming or to claim the same or any part
thereof.
The easement, rights, and privileges granted herein are
exclusive, and Grantor covenants that he will not convey any
other easement or conflicting rights within the premises covered

by this grant, without the express written consent of Grantee,
which consent shall not be unreasonably withheld.
Grantor shall not erect or construct any building or other
structure, or drill or operate any well, or construct any

purpose of construction and maintenance of a sanitary sewer line, being upon
that certain 6.83 acres conveyed to Bert Hall, et ux, by deed recorded in Volume
606, Page 667 of the Deed Records of Williamson County, Texas, and being more
particularly described by metes and bounds as follows:
BEGINNING at a point, being the Northeast corner of said 6.83 acres, being the
Northeast corner and POINT OF BEGINNING of the hereinafter described easement;
THENCE along the East line of said 6.83 acres, for the East line hereof,
