Box 660268 • Dallas, Texas 75266-0268 May 25, 1984 (second letter) You have requested permission to construct a 14 -inch water line within the bounds of Texas Power & Light Company's transmission right of way. This is to advise that Texas Power & Light Company is agreeable to the con- struction of the 14 -inch water line if the facility is located as shown on the attached print, marked Exhibit "A," and upon the following conditions: 1. That you agree to indemnify and hold harmless Texas Power & Light Company from claims or damages asserted by any person against this company, arising out of the construction and maintenance of the 14 -inch water line, unless caused solely by negligence of Texas Power & Light Company. 2. No boom -type equipement Shall be used in connection with any work to be performed by you, your employees or contractors, unless special arrangements are made with Texas Power & Light Company's Division Supervisor of Transmission in Waco, Mr. Bob Teer, telephone no. 817/753 -7385. 3. It is understood and agreed that Texas Power & Light Company only holds easement rights on the property involved; there - fore you will be required to obtain whatever rights, other than Texas Power & Light Company's that are necessary. 5. That there shall be no blasting within 25 ft. of Texas Power & Light Company's structures. - If you are willing to accept this conveyance on these terms, please note your approval below, have signature properly notarized with notary seal affixed and return the original to Texas Power & Light Company, P.O.
