COUNTY OF WILLIAMSON S
RESOLUTION
On this day at a regular meeting of the City Council of the
City of Round Rock, Williamson County, Texas, a Resolution was
proposed which was seconded and which was approved and adopted
by a majority vote of the Council, the Resolution being as follows:
WHEREAS, the State Department of Highways and Public Transportation
proposes to make certain improvements on U.S. Highway 81 at
Interstate Highway 35 in the City of Round Rock which will apparently
cause a portion of the present right of way of said highway
to become no longer needed for highway purposes or for the use
of citizens for road purposes, said surplus land being more
particularly described in the attached Exhibit A; and
WHEREAS, the aforesaid highway improvements will require that
certain other land, owned by Emkay Development Company, Inc.,
be conveyed to the State for highway and public transportation
purposes, said land being more particularly described in the
attached Exhibit B; and
WHEREAS, the State and the owners mutually agree to an exchange
of said lands necessary to facilitate the highway improvements;
and
WHEREAS, Emkay Development Company, Inc. has agreed to provide
necessary funds to the City of Round Rock for the construction
and related costs of the highway improvements, said funds to
be deposited into the State Treasury Trust Fund 927 for expenditure
by the State Department of Highways and Public Transportation
for construction of the aforesaid highway improvements;
NOW, THEREFORE, BE IT RESOLVED, that the City Council of the
City of Round Rock requests the State Department of Highways
and Public Transportation declare that certain right - of - way
owned by the State, which will no longer be needed for use of
citizens as a road following completion of the proposed construction,
surplus for highway or public transportation purposes so that
it may be used for part or full consideration for the needed
right of way; and
BE IT FURTHER RESOLVED, that the City Council of the City of
Round Rock agrees to be the local sponsoring agency for the
aforesaid highway improvements conditioned that the necessary
funding is provided by Emkay Development Company, Inc., and
the Mayor of Round Rock is hereby authorized to sign any and
all documents relating to such project on behalf of the City
of Round Rock.

BEING MORE PARTICULARLY DESCRIBED BY METES AND BOUNDS AS

BEGINNING at a nail found in a broken concrete highway monument in the west
right -of -way line of said U.S. Highway 81, being the most northeasterly corner of
that certain 5.956 acre tract of land conveyed to Triangle Land Venture recorded in
Volume 1044, Page 106 of the Williamson County Deed Records, and being a
northwesterly interior corner of the herein described tract;
THENCE departing the said west line of U.S. Highway 81, S 79 25' 07" W, a
distance of 127.86 feet to a nail found in a broken concrete highway monument in
the existing east right -of -way line of Interstate Highway 35, being the most
northwesterly corner of said 5.956 acre tract and being a proposed westerly corner
hereof;
THENCE departing the said existing east line of Interstate Highway 35, over and
across said Interstate Highway 35 right -of -way for the proposed east right -of -way
line of Interstate Highway 35 the following two (2) courses and distances:
1. N 00 20' 25" W, a distance of 167.53 feet to an iron rod set,
and
2. N 00 44' 04" W, a distance of 150.69 feet to an iron rod set at
a point of curvature;
THENCE departing said proposed east line of 11-1-35 the following two (2) courses
and distances:
1. a distance of 60.91 feet along the arc of a curve to the right
having a radius of 30.00 feet, with a central angle of
116 20' 05" whose chord bears N 57 25' " E a distance of
50.98 feet to an iron rod set at the point of tangency, and
2. S 64 23' 59" E for a distance of 90.12 feet, over and across the
said right -of -way of U.S. Highway 81 to an iron rod found in the
curving east right -of -way line of said U.S. Highway 81, and the
west line of a 61.825 acre tract of land conveyed to Emkay
Development Company, Inc. by deed recorded in Volume 1133,
Page 613, Williamson County Deed Records;
THENCE along the said east line of U.S. Highway 81 and west line of the
61.825 acre tract, the following two (2) courses and distances:
1. a distance of 93.69 feet along the arc of a curve to the left
having a radius of 5437.24 feet with a central angle of
00 59' 14" and whose chord bears S 20 59' 17" E a distance of
93.68 feet to an iron rod found at a point of tangency, and
2. S 21 27' 35" E for a distance of 164.71 feet to an iron rod
found, being the southwest corner of said 61.825 acre tract and
the northwest corner of a 71.838 acre tract of land conveyed to
said Emkay Development Company, Inc., by deed recorded in
Volume 1047, Page 701, Williamson County Deed Records;
