R-86-871 - 5/22/1986WHEREAS, the City of Round Rock is desirous of selling surplus vehicles and equipment; and WHEREAS, a professional auctioneer is required in connection with said sale; and WHEREAS, J.C. Harper Auctioneers has submitted a proposed agreement to provide said services; and WHEREAS, the City Council desires to enter into said agreement with J.C. Harper Auctioneers, Now Therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the Mayor is hereby authorized and directed to execute on behalf of the City of Round Rock an agreement with J.C. Owner warrants and guarantees all goods offered for sale to be free from any and all liens, encumbrances or claims of every nature whatsoever, and that Owner has good title to said goods offered for sale; and Owner agrees to indemnify and save Auctioneer harmless from any loss Auctioneer may sustain arising from any lien, encumbrance, claim or defect in title to said goods, including all reasonable costs, expenses and attorneys fees. 6. Auctioneer agrees to furnish a clerk for the auction sale and an auction staff sufficient to hold the auction sale. 7. If the goods sold are subject to the State tax, Auctioneer agrees to collect said tax. 8. Owner agrees to sell nothing connected with said sale after the date hereof without the prior written permission of Auctioneer. 9. Owner agrees not to interfere in any way after the auction starts. 10. Auctioneer shall conduct this auction sale in accordance to the laws of this State and the provisions of his license issued by the State. 11. Auctioneer agrees to prepare all advertising material and publicity reasonably necessary to advertise the sale and promote the attendance of buyers, subject to the dollar limit hereinafter set out. Owner shall bear the cost of such publicity and advertising expended directly for the purpose of the sale in an amount not to exceed $ 0 12. This property shall be sold to the highest bidder without minimum or reservation. Owner acknowledges, understands and agrees that Auctioneer cannot and does not represent or warrant that the property, or any part thereof, will bring any particular minimum price at the auction sale. 13.
