WHEREAS, the City of Round Rock wishes to construct a pedestrian
bridge across Lake Creek; and
WHEREAS, professional engineering services are required in connection
with said project; and
WHEREAS, HGE, submitted a contract to provide said engineering
services; and
WHEREAS, the City Council desires to enter into said contract with
HGE, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor is hereby authorized and directed to execute on behalf
of the City of Round Rock a contract for engineering services with HGE
for a pedestrian bridge across Lake Creek, a copy of said contract being
attached hereto and incorporated herein for all purposes.

Lake Creek Pedestrian Bridge
Dear H.B. Prete:
I an pleased to present this proposal /contract for professional engineering
services for the above referenced project. This project consist of a pedestrian
bridge across Lake Creek adjacent to Deepwood Drive. The bridge will be
approximately 125' long. The following is a scope of services HGE is proposing
to provide:
STRUCTURAL ENGINEERING SERVICES:
1. Engage the services of a Geotechnical Consultant to drill two borings (one
at each abutment); and provide a log of borings which will indicate depth
of adequate bearing strata.
2. Investigate level of 25 year flood, to set bridge elevation.
3. Preform limited topographic survey of approach areas for the construction
plans.
4. Prepare specifications for the pre — engineered pedestrian bridge.
5. Prepare construction plans for the bridge abutments and approaches.
6. Prepare Bid Documents for construction of the bridge and execute Contract
for Construction between Owner and Successful Contractor.
7. Prepare Statements of Probable Construction Cost for Owner review.
8. Provide shop drawing review of bridge structure.
9. Provide three site visits to assure conformance of construction to design.

ITEMS SPECIFICALLY EXCLUDED:
1. Plans for hike and bike trails to and from bridge approach.
2. Construction stake out of abutments.
The following services will be performed for the lump sum fee of $5,935.00. We
are able to start our services upon written acceptance of this proposal. We
will bill you monthly for services performed. In order to insure the orderly
and continuous progress of the project, we expect payment of our bills by the
10th of the month following date of our billing. Work performed outside the
scope of services defined above will be billed on an hourly basis of direct
personnel expense times a multiplier of 2.65. Principal's time will be billed
at $65.00 per hour.
If you agree with the terms of this proposal /contract and the attached General
Provisions, please sign both proposals, initial the General Provisions, and
return one complete contract to me. Please retain the second contract for
your files.

GENERAL PROVISIONS
All documents including drawings and specifications prepared by engineer
pursuant to this agreement are instruments of service in respect of the
project. They are not intended or represented to be suitable for reuse
by client or others on extensions of the project or on any other project.
Any reuse without written verification or adaptation by engineer for the
specific purposes intended will be at client's sole risk and without
liability or legal exposure to engineer; and client shall indemnify and
hold harmless engineer from all claims, damages, losses and expenses
including attorneys' fees arising out of or resulting therefrom. Any
such verification or adaptation will entitle engineer to further compen-
sation at rates to be agreed upon by client and engineer.
If client fails to make any payment due engineer for services and expens-
es within thirty days after receipt of engineer's bill therefor, the
amounts due engineer shall include a charge at the rate of 11 per month
from said thirtieth day, and in addition, engineer may, after giving
seven days' written notice to client, suspend services under this agree-
ment until he has been paid in full all amounts due him for services and
expenses.
The obligation to provide further services under this agreement may be
terminated by either party upon seven days' written notice in the event
of substantial failure by the other party to perform in accordance with
the terms hereof through no fault of the terminating party. In the event
of any termination, engineer will be paid for all services rendered to
the date of termination, all reimbursable expenses and termination ex-
penses.
Client and engineer each binds himself and his partners, successors,
executors, administrators, assigns and legal representatives to the other
party of this agreement and to the partners, successors, executors,
administrators, assigns, and legal representatives of such other party,
in respect to all covenants, agreements and obligations of this agree-
ment. Neither client nor engineer shall assign, sublet or transfer any
rights under or interest in this agreement without the written consent of
the other. Nothing herein shall be construed to give any rights or
benefits hereunder to anyone other than client and engineer.

ITEM: 9E - Consider a resolution authorizing the Mayor to enter into an
agreement with HGE for engineering services for a pedestrian
bridge over Lake Creek.
The pedestrian bridge is a planned CIP Project for fiscal 85 -86.
The purpose of the bridge is to facilitate pedestrian school
traffic and leisure time activities.
Public Works has approved the construction of a pedestrian bridge
over Lake Creek and has reviewed the agreement with Hagood • Griffin
Engineers (HGE).
Staff recommends that the Mayor be authorized to enter into this
agreement.
