Please find enclosed two originals of the Agreement
regarding paving, signed by the Valentine Executive Vice
President. Please have the appropriate authorized official of
the city of Round Rock sign each original, and return one of them
to me. We cannot honor the Agreement unless signed by both
parties.
I had mentioned to you on the phone that I obtained from a
local contractor an estimate for the paving work to be done, and
that it was considerably less than the figure of $144,000 which
you had previously mentioned. You said that the actual figure
would be lower.
You also said that you would send a letter to clarify the
Agreement, defining the dollar figure implicit in the phrase,
"Grantor agrees to pay for the construction of School Days Lane
on the tract or parcel of land described herein ". I expect that
the figure will reflect the cost for construction relating to our
parcel and will not include holdbacks or other miscellaneous or
contingent figures, but will indicate the final fair market price
paid to the contractor which he is allowed to keep.
I look forward to receiving your letter and thereby
completing this transaction.
