MIKE ROBINSON, Mayor City of Round Rock, Texas B THE CITY OF ROUND ROCK : CITY OF ROUND ROCK Grantor : Grantee STATE OF TEXAS COUNTY OF WILLIAMSON PUBLIC UTILITY EASEMENT : KNOW ALL MEN BY THESE PRESENTS That The City of Round Rock, Texas, hereincalled Grantor (whether one or more), for a good and valuable consideration paid by the City of Round Rock, Texas, 214 East Main Street, Round Rock, Texas, a municipal corporation, herein called Grantee. receipt of which consideration is hereby acknowledged, does hereby GRANT, SELL AND CONVEY unto Grantee an easement and right-of-way upon and across the following described property of Grantor: All that certain tract piece or parcel of land lying and being situated in the County of Williamson, State of Texas described in EXHIBIT "A" attached hereto and made a part hereof for all purposes to which reference is here made for more particular description of said property. The right -of -way, easement, rights, and privileges herein granted shall be used for the purpose of placing, constructing. operating, enlarging, repairing, maintaining, rebuilding, replacing relocating and removing water lines, sewer lines, and any and all other public utilities deemed necessary by Grantee, together with all necessary conduits, valves. vaults, manholes. ventilators and appurtenances. And Grantor does hereby bind its executors, administrators and assigns to WARRANT AND FOREVER DEFEND, all and singular, the said premises unto the City of Round Rock, its successors and assigns, against every person whomsoever lawfully claiming or to claim the same or any part thereof. During construction, fences will he maintained and livestock will not be allowed to escape because of the construction work. Any fences which have to be disturbed during construction or subsequent repair or maintenance will be restored to the condition in which they were found before such work was undertaken. In order to do maintenance and repair work to the utilities for which this easement is being granted, the Grantee or its duly authorized agents shall use the gate or cattle guards that are in existence at the time the maintenance or repair work is done. In the event that fences must be disturbed in order to do required repair or maintenance work, the Grantee will notify the Grantor's of the necessity and nature of the maintenance or repair work. Grantor's covenant that they will not convey any other easement or conflicting rights within the premises covered by this grant, without the express written consent of Grantee, which consent shall not be unreasonably withheld, Grantee will notify Grantors, in writing, of any assignment of this easement. Grantor's shall have the right to use the surface but shall not erect or construct any building or other structure, or drill or operate any well, or construct any reservoir, or other obstruction on the strip or diminish or substantially add to the ground cover over the pipelines. Additional consideration is given by the placement of a 18" sewer tap at manhole #I4 on Grantor's property. Grantor will not be liable for surveying, recording easements or other incidental expenses related to the granting of this easement. Grantee, by acceptance of this easement, warrants that the shall defend indemnify and hold harmless Grantor for any cause of action, lawsuits, damages or injuries resulting from activity in using, developing or maintaining such easement. This shall he construed to include damages suffered by any third person not a party, to this contract.
