SEWER EASEMENT
KNOW ALL MEN BY THESE PRESENTS
That the City of Round Rock, herein called, Grantor (whether one
or more), for a good and valuable consideration paid by the City of
Round Rock, Texas, 214 E. Main Street, Round Rock, Texas, a municipal
corporation, herein called Grantee, receipt of which consideration is
hereby acknowledged, does hereby GRANT, SELL, AND CONVEY unto Grantee
an easement and right -of -way upon and across the following described
property of Grantor:
All that certain tract, piece or parcel of land,
lying and being situated in the County of
Williamson, State of Texas described in EXHIBIT
"A" attached hereto and made a part hereof for all
purposes, to which reference is here made for more
particular description of said property.
The right -of -way, easement, rights, and privileges herein granted
shall be used for the purpose of placing, constructing, operating,
enlarging, repairing, maintaining, rebuilding, replacing, relocating
and removing sewer lines, and any and all other public utilities
deemed necessary by Grantee, together with all necessary conduits,
valves, vaults, manholes, ventilators and appurtenances.
TO HAVE AND TO HOLD the above described easement and right -of -way
in and to said premises with the right of ingress and egress thereto,
together with all and singular the ususal rights thereto in anywise
belonging, unto the City of Round Rock and its successors and assigns
forever. And Grantor does hereby bind its executors, administrators
and assigns to WARRANT AND FOREVER DEFEND all and singular, the said
premises unto the City of Round Rock, its successors and assigns,
against every person whomsoever lawfully claiming or to claim the
same or any part thereof.
The easement, rights, and privileges granted herein are
exclusive, and Grantor covenants that he will not convey any other
easement or conflicting rights within the premises covered by this
grant, without the express written consent of grantee, which consent
shall not be unreasonably withheld.
Grantor shall not erect or construct any building or other
structure, or drill or operate any well, or construct any reservoir
or other obstruction on the strip, or diminish or substantially add
to the ground cover over the pipelines. in addition to the easement,
rights, and privileges herein conveyed, Grantee shall have the right
to use for a temporary construction easement so much of the surface
of Grantors' property as may be reasonably necessary to construct and
install within the right -of -way granted hereby the facilities
contemplated by this grant; but in no event shall the temporary
construction easement be in excess of that described and depicted on
Exhibit "A" attached hereto.

FIELD NOTE DESCRIPTION OF A 0.12 ACRE TRACT OF LAND, TO BE
USED AS A TWENTY (20) FOOT WIDE WASTEWATER EASEMENT, SITUATED IN THE
DAVID CURRY SURVEY, ABSTRACT 130, WILLIAMSON COUNTY, TEXAS, BEING
OVER AND ACROSS LOT 4, BLOCK J OF "THE WOODS SECTION TWO" A
SUBDIVISION OF RECORD IN CABINET G SLICES 89 -90 OF THE PLAT RECORDS OF
WILLIAMSON COUNTY, TEXAS, SAID 0.12 ACRE TRACT BEING MORE
PARTICULARLY DESCRIBED BY METES AND BOUNDS A FOLLOWS:
COMMENCING at an iron rod found for the northwest corner of said Lot 4,
being also the northeast corner of Lot 3, Block J of said "The Woods Section Two" and
being in the south line of that certain 172.48 acre tract of land as described in deeds to
Edgar Hoppe of record in volume 429, Page 485, Volume 437, Page 523 and Volume 458,
page 533 of the Deed Records of Williamson County, Texas;
THENCE, with the north line of said Lot 4 and the south line of said 172.48
acre tract N 69 ° - 37' -45" E, a distance of 102.17 feet to the POINT OF
BEGINNING and being the northwest corner hereof;
THENCE, continuing with the north line of said Lot 4, the south line of said
172.48 acre and the north line hereof N 69 °- 37' -45" E, a distance of 20.82 feet to a
point for the northeast corner hereof;
THENCE, departing the south line of said 172.48 acre tract and over and
across said Lot 4 with the east line hereof 5 04 ° - 16' -49" E, a distance of 252.81 feet to
a point for the southeast corner hereof, being also in the south line of said Lot 4 and
being in the north line of a 50.00 foot right -of -way known as Woods Boulevard;
THENCE, with the south line of said Lot 4, the north right -of -way line of
said Woods Boulevard and the south line hereof the following two (2) courses and
distances:
1. S 49 ° - 38' -30" W, a distance of 6.99 feet to a point of curvature, and
2. a distance of 16.97 feet along the arc of a curve to the right, the
radius of which is 125.00 feet, the central angle of which is
07 ° - 46' -43" and the chord of which bears S 53 ° - 31' -52" W, a distance
of 16.96 feet to a point for the southwest corner hereof, from which
an iron rod found for the southwest corner of said Lot 4, southeast
corner of Lot 1 of said Block "3 ", and being in the north line of said
Woods Boulevard bears 64.51 feet along the arc of a curve to the right
and a chord of which bears S 70 ° - 53' -41" W, a distance of 63.79 feet.
THENCE, departing the curving north line of said Woods Boulevard and over
and across said Lot 4 with the west line hereof N 04 ° - 16' -49" W, a distance of 260.20
feet to the POINT OF BEGINNING and containing 0.12 acres of land.
TOGETHER WITH a temporary 40.0 to 102.17 foot wide varying width
construction easement lying parallel and adjacent to the west line hereof.
ALSO TOGETHER WITH a temporary 15.0 foot wide construction easement
lying parallel and adjacent to the east line hereof.

RESOLUTION NO. 9000
WHEREAS, the City of Round Rock is a participant in the
regional wastewater collection and treatment system for the
Brushy Creek Watershed; and
WHEREAS, the City of Round Rock has previously entered into
an interim service agreement, and an Onion Creek pumpover
contract; and
WHEREAS, in order to implement those contracts, easements
are necessary to construct a portion of the Onion Creek sewer
line, Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS
That the Mayor be and is hereby authorized and directed to
execute a Public Utility Easement, a copy of such agreement
being attached hereto and incorporated herein for all purposes.
