attach a guide wire to an existing service pole at Kinningham Park; and
WHEREAS, this easement will provide better electric service to the
South Creek Subdivision; and
WHEREAS, the Round Rock City Council wishes to approve the requested
easement; Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor be and is hereby authorized and directed to execute
a Public Utility Easement, a copy of such agreement being attached hereto
and incorporated herein for all purposes.

COUNTY OF WILLIAMSON) KNOW ALL MEN BY THESE PRESENTS:
That The City of Round Rock, acting by and through its Mayor, Mike Robinson, of Williamson County, Texas, hereafter
called "Grantor," whether one or more, for and in consideration of one dollar (41,001 to Grantor in hand paid by HIE
POWER & LIGHT COMPANY a division of TEXAS UTILITIES 0100THIC COMPANY, a Texas corporation, P. 0. Box 160268, Dallas,
Texas 75166 -0268, hereinafter termed Grantee, has granted, sold and conveyed and by those presents, does grant, sell
and convey unto said corporation, an easement and right -of -way for an overhead and /or underground electric supply lira
consisting of variable number of wires and circuits, and all necessary or desirable appurtenances, and for communization
lines and appurtenances, over, across and upon Grantor's land in the P.A. Holder Survey, Abstract No. 297, Williamson
County, Texas, more particularly described in deed from South Creek Joint Venture to The City of Round Pock, dated
January 11, 1985, recorded in Cabinet P. Slide 191, Deed Records said County.
Said overhead andlor underground electric supply line shall he located on or across said land as shown on EX913IT ,
which is attached hereto and made a part hereof,
Grantor recognizes that general course of such line, as above described is based upon preliminary surveys only,
and hereby agrees that the easement hereby granted shall apply to the actual location of said line when
constructed.
Grantor agrees to inform all other parties having a right to construct underground facilities in said easement as
to the existence and location of any underground electrical facilities constructed by Company hereunder,
Together with the right of ingress and egress over Grantor's adjacent lands to or from said right of way for the
Purpose of constructing, improving, reconstructing, repairing, inspecting, maintaining and removing said line and
appurtenances; the right to relocate said line in the sane relative position to any adjacent road if and as
widened in the future; the right to tear down, remove, or prevent the construction of, for a distance of five (51 fee:
on each side of the center line, as shown on EXHIBIT A, any and all buildings, structures or other obstructions which,
in the sole judgement of the Company_ may endanger or interfere with the efficiency, safety, or convenient operation of
said line and its appurtenances; and the right to trim or cut down trees or shrubbery to the extent, in the sole
judgement of the company, necessary to prevent possible interference with the operation of said line or to remove
possible hazard thereto.
Grantor shall not make changes in the grade, elevation, or contour of the lard, or construct berms, pools, lakes,
ponds or other improvements on the land which wild interfere with the exercise by Grantee of the rights herein
granted, unless Grantor shall have obtained the prior written consent of Grantee.
Grantee shall have tie right to erect poles, guy anchorages, and other facilities along the course of said line.
TO HAVE AND TO HOLD the above described easement and rights unto the said Grantee, their successors and assigns,
until all of said lines shall be abandoned.

permission to install its facilities across the property
located on Kinningham Park in South Creek. The form has been
prepared for Mr. Robinson's signature where his name and title is
typed. Please have him sign exactly in like kind as his name
appears there.
Also, please have the document notarized and acknowledged on the
back. You will find three (3) acknowledgements there, two (2)
for individuals, and one (1) for a corporation. Please use the
acknowledgement for a corporation.
When complete, please call me at 255 -3666 and I will pick the

matter.
