RESOLUTION NO.
WHEREAS, Virg S. and Nancy 1. Rabb desire to give certain
real property to the City of Round Rock for park and recreation
purposes, and
WHEREAS, it may be necessary for the Mayor to execute
documents to complete the conveyance, NOW THEREFORE
BE IT RESOLVED BY THE CITY COUNCIL OF ROUND ROCK, TEXAS
That the Mayor be and is hereby authorized to sign any and
all documents necessary to complete the conveyance to the City
of Round Rock, Texas real property being given by Virg S. and
Nancy 1. Rabb.

ITEM: 13A- Consider a resolution authorizing the Mayor to sign any and
all documents necessary to complete the transfer of certain
real property from the Virg Rabb family.
The Virg Rabb Family is donating 14± acres along Brushy Creek,
to the City,as a park.
Staff and Council rgresentatives have toured the property. All
agree that the property will be an asset and welcomed addition to
our park land inventory.
Staff recommends approval.

That we, Virg S. Rabb and Nancy I. Rabb, of Williamson
County, in the State of Texas, for and in consideration of Ten
dollars and other valuable consideration to the undersigned paid
by the grantee herein named, the receipt of which is hereby
acknowledged, have granted, given and conveyed, and by these
presents do grant, give and convey unto the City of Round Rock,
of the County of Williamson and State of Texas, all of the
following described real property in Williamson County, Texas to
wit:
See Attached Exhibit "A".
TO HAVE AND TO HOLD the above described premises together
with all and singular the rights and appurtenances thereto in
anywise belonging, unto said grantee, and its successors
forever; and we do hereby bind our heirs, executors and
administrators to warrant and forever defend all and singular
the said premises unto said grantee, and its successors, against
every person whomsoever lawfully claiming or to claim the same

or any part thereof for so long as said property is used and
maintained as a City Park facility, to be known as Rabb Park,
said park to be operational on or before December 31, 1991 and

Tract 1 of 2 Tracts:
Being 9.05 acres of the P.A. Holder Survey in Williamson County,
Texas, part of a tract of 73.78 acres described in a deed from Claude
Berkman to Phillip Warner in 1966, of record in Vol. 491, Page 111,
Deed Records of Williamson County, Texas, Survey on the ground in
Sept. 1967, by W.F. Forest. Beginning at the SE corner of the 73.78
acres, in the center of Brushy Creek; Thence S 77 deg. 15' W 929.5
feet upstream with the center of the creek; Thence N. 3 deg. 30' W
278 feet and N O deg. 30' W 200 feet with a fence, to set an iron pin
midway up a bank or bluff, about 12 to 15 feet high; Thence with the
bluff midway between top and bottom, as follows: N 83 deg. 50' E
296.5 feet, S 89 deg. 30' E 130 feet, N 84 deg. 30'; E 166.7 feet, N
52 deg. 45' E 70 feet, N 85 E 210 feet N 5 W 24 feet and N 89 E. 70
feet to set an iron pin in the East fence of the 73.78 acre tract, on
the side of the bluff and in the East line of a 30 foot road
easement; Thence S 0 deg. 15' E 405 feet with an old fence, to the
Point of Beginning. The above mentioned road easement of 30 feet
width is to be along the East property line of the Phillip Warner
tract, North from the purchased tract of Grantees herein for 623 feet
more or less up to the I&GN Railroad right of way. A further
easement 30 feet in width is hereby granted in this deed and made a
part hereof from the North side of the I&GN Railroad right of way to
the U.S. 79 right of way on the North side of the Phillip Warner
Tract a distance of 350 feet more or less, also along the East
property line of the Phillip Warner tract.
Tract 2 of 2 Tracts:
All that certain tract or parcel of land lying and being situated
in Williamson County, Texas, out of and a part of the P.A. Holder
Survey, Abstract No. 297, out of and a part of a tract of 69.81 acres
described in a Deed from C. H. Warner to P. W. Warner, of record in
Volume 369, page 299 of the Deed Records of Williamson County, Texas,
(about 0.05 acres of this tract is also out of a 73.78 acre tract
conveyed to P.W. Warner by Claude Berkman by Deed of record in Volume
491, page 111 of the Deed Records of Williamson County, Texas) and
more particularly described as follows:
BEGINNING at the N. W. corner of a tract of 9.05 acres sold by
Warner to Virgil Rabb in 1967, in the east line of the 69.81 acre
tract and in the West line of the 73.78 acre tract, 478 feet from the
common South corner of same;
THENCE S. 68 deg. 06' W. 568.4 feet to set an iron pin about 1
foot South of a clump of 3 small trees;
THENCE S. 72 deg. 19' W. at 178 feet pass through an 8 inch Live
Oak, in all 194 feet to set an iron pin in an East line of a tract of
5.02 acres sold by Warner to Dean Knox in 1962;
THENCE S. 31 deg. 15'E. 169.7 feet to set an iron pin at the base
of a 8 inch leaning pecan tree;
THENCE S. 59 deg. E. 118 feet to a 24 inch Sycamore on the North

storage area.
