Main Street Round Rock, Texas 78664 (hereinafter the Lessee). RECITALS: By lease dated March 1,. 1987, identified in the records of the Lessor as Agreement No. LA -33789 (herein called "Original Agreement "), the Lessor is leasing to the Lessee certain premises at Round Rock, Texas. follows: The parties now desire to modify the Original Agreement to provide for the addition of 8.47 acres of property. AGREEMENT: Lease Supplement Fbrm App. 8/86 AVP I al,' NOW, THEREFORE, IT IS AGREED by and between the parties hereto as Section 1. INCREASE IN RENTAL. Effective as of September 10, 1987 the Lessee agrees to pay to the Lessor as rental for the use of the leased premises as shown on Exhibit B the sum of TWO THOUSAND THREE HUNDRED THIRTY DOLLARS ($2,330.00) for the term of the Lease. Section 2. ADDITION OF PRINT Print dated June 19, 1987, attached hereto as Exhibit "B" shall be and hereby is included as an exhibit to the Original Agreement, and from and after the effective date herein the premises shown on the print attached hereto and dated June 19, 1987 shall be, and hereby are, fixed as part of the premises of the Lessor leased to the Lessee under the Original Agreement. Section 3. PROTECTION OF FIBER OPTIC CABLE SYSTEMS The following is hereby made a part of the Original Agreement: (a) Fiber optic cable systems may be buried on the Lessor's property. Lessee shall telephone the Lessor at 1- 800 - 336 -9193 (a 24 -hour number) to determine if fiber optic cable is buried anywhere on the Lessor's premises to be used by the Lessee. If it is, Lessee will telephone the telecommunications company(ies) involved, arrange for a cable locator, and make arrangements for relocation or other protection of the fiber optic cable prior to beginning any work on the Lessor's premises. 1 (b) In addition to the liability terms elsewhere in this Agreement, the Lessee shall indemnify and hold the Lessor harmless against and from all cost, liability, and expense whatsoever (including, without limitation, attorney's fees and court costs and expenses) arising out of or in any way contributed to by any act or omission of the Lessee, its contractor, agents and /or employees, that causes or in any way or degree contributed to (1) any damage to or destruction of any telecommunications system by the Lessee, and /or its contractor, agents and /or employees, on Lessor's property, (2) any injury to or death of any person employed by or on behalf of any telecommunications company, and /or its contractor, agents and /or employees, on Lessor's property, and/or its contractor, agents and /or employees, on Lessor's property, and /or (3) any claim or cause of action for alleged loss of profits or revenue by, or Loss of service by a customer or user of, such telecommunication company(ies). Section 4. EFFECTIVE DATE This Supplemental Agreement shall be effective as of the date first hereinabove written. Section 5. TERM. The Original Agreement, as hereby modified, shall remain in full force and effect, subject to termination as provided therein.
