Attorneys upon the terms and conditions of the letter agreement submitted by said firm, Now Therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the Mayor of the City of Round Rock, Texas, is hereby authorized and directed to execute on behalf of the City, the retainer agreement set forth in the letter from Womack & McClish, P.C. Lawyers time will be billed at $150.00 per hour for work done by either partner, Danny M. Womack or John N. McClish, and at $125.00 per hour for work done by any associate for the firm; 3. There will be no billing for support personnel time such as secretaries, receptionist, runners, etc.; 4. All other expenses including expert witness fees, depositions, transcripts, etc. will be billed at our cost; and, 5. Billing will be monthly and will include a letter addressed to the council giving an account of that month's activities on the suit. City Council of Round Rock recognizes that the law firm of Womack & McClish's primary business is the representation of landowners in Eminent Domain actions and acknowledges that the firm has in the past, and on any project other than the taking involved in Cause No. 86-397 - C, will in the future be free to represent landowners in actions involving the City of Round Rock even if such actions are concurrent with the above described litigation.
