RESOLUTION NO. 9
WHEREAS, in conjunction with the construction of the raw
water intake facilities at Lake Georgetown, certain equipment
must be ordered by Pedernales Electric Cooperative, Inc., and
WHEREAS, it is imperative that the project not be delayed
due to the upcoming high summer water usage, and a delay in
ordering of the equipment by Pedernales Electric Cooperative,
Inc. will cause a delay in completing the project, NOW THEREFORE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS
That the Mayor be and is hereby authorized to execute an
agreement with Pedernales Electric Cooperative, Inc. for the
purchase of equipment, a copy of said agreement being attached
hereto and incorporated herein for all purposes.

WHEREAS, the City of Round Rock is desirous that
Pedernales Electric Cooperative, Inc. (PEC) step down the
primary voltage at their raw water intake at Lake Georgetown
from 24.9 KV to 12.47 KV.
WHEREAS, PEC is willing to provide service at 12.47 KV.
NOW, THEREFORE, it is hereby agreed between the City of
Round Rock and PEC as follows:
1. City of Round Rock will make payment to PEC the
estimated cost of $12,300.00 for the voltage
step down.
2. PEC will purchase and install step down equipment
and convert metering. Work will be completed
within two weeks after receipt of equipment.
3. PEC will, upon completion of the voltage step
down, refund any part of the estimated cost not
used.
4. The City of Round Rock will, upon completion of
the voltage step down, reimburse PEC for any
cost in excess of the estimated cost up to $3000.00.

etc.), hereinafter called "Consumer,"
Cooperative agrees to sell and deliver to Consumer, and
Consumer agrees to purchase and receive from Cooperative, for
Consumer's use and not for resale, electric power and energy at
raw water intake Lake Georgetown hereinafter called "Point of
Delivery," upon the following terms:
1. Consumer shall pay Cooperative monthly for service
hereunder up to and including 1200 (#xipytg) (horsepower)
hereinafter called "Contract Load" at the rates and upon the terms
and conditions set forth in Rate Schedule MP1 attached
hereto and made a part hereof. Should Coop adopt a
different rate schedule or schedules to cover the type of load
described above, or should Consumer's load requirement later
exceed said Contract Load, and Cooperative is willing to furnish
such excess, then Consumer agrees at such time, or times, and
thereafter to pay Cooperative at the rates and upon the terms and
conditions set forth in the Cooperative's rate schedule then in
effect, applicable to service being rendered Consumer.
Cooperative agrees to use reasonable diligence to provide the
service specified above, but shall not be held liable for damages
for any failure to do so.
2. The initial billing period hereunder shall
Consumer begins using electric power and energy, or
after Cooperative notifies Consumer in writing that
available hereunder, whichever shall occur first.
3. Bills for service hereunder shall be due and payable at
the office of Cooperative in Johnson Ci v , Texas, monthly
within fifteen (15) days from date of bill. If Consumer shall
fail to pay any such bill within such fifteen (15) day period, it
will be delinquent, and the Cooperative may discontinue service
hereunder seven (7) days thereafter, provided the Cooperative, at
least seven (7) days prior to disconnecting Consumer, mails a
notice to the Consumer that his account is delinquent and that
service will be disconnected if the account is not paid in full by
the specified date. The Cooperative may, at its option, terminate

all of its obligations hereunder by giving ten (10) days notice in
writing to Consumer following such default, and in case of such
discontinuance and /or termination, Consumer shall owe Cooperative
not only the amount then due for service hereunder, but as
liquidated damages to Cooperative and not as a penalty, a further
sum equal to the total for the unexpired term of this agreement
of the monthly minimum amounts guaranteed under Cooperative's
rate schedule then in effect hereunder.
4. Consumer hereby agrees to abide by all rules and
regulations of the Cooperative as set forth in the Cooperative's
effective Service Policy and Line Extension Policy, and by all
amendments and revisions in said policies as may be made from time
to time by the Board of Directors.
5. This agreement is unassignable except by written consent
of both parties.
6. Venue of any litigation arising hereunder shall be in
Blanco County, Texas.
7. Consumer hereby grants Cooperative rights -of -way and
permits necessary for performance hereunder, over, on or upon land
owned or controlled by Consumer including, upon the termination of
this agreement for any reason, the right to remove from Consumer's
premises all meters and other property of Cooperative.
8. This agreement shall become effective on the date first
above written and shall remain in effect until years
following the start of said initial billing period, a unless
written notice is given by either party to the other not less than
thirty (30) days before the termination of said year period,
then this agreement shall be continued from month to month
thereafter until terminated by such written notice given not less
than thirty (30) days before the expiration of one such monthly
period.
IN WITNESS WHEREOF, the parties hereto have caused this
agreement to be signed in triplicate as of the date and year first
above written.

MUNICIPAL POWER RATE
SCHEDULE MP -1
Applicability
This schedule is applicable to incorporated municipalities for
electric heat, light and power requirements for the operation of
water pumps and sewage disposal plants.
Character of Service
.Alternating current, single or three phase, sixty cycles. Voltage
_supplied will be at the discretion of Cooperative and will be
determined by the voltage available from distribution lines in the
vicinity and /or other conditions.
Rate
'Customer Charge: $6.00 per meter.
Energy Charge: 5.16C per KWH.
The above rate will be increased or decreased in accordance with
Schedule PCA.
Contract Requirement
Customers taking service under this schedule shall be required to
execute contracts with minimum term of one year.
Payment
The above rates are net, the gross rates being five percent (5%)
higher. In the event that the current monthly bill is not paid
within fifteen (15) days from date of bill, the gross rates shall
apply.
Service under this schedule is subject to the rules and
regulations of the Cooperative as filed with the Public Utility
Commission.
