cross and parallel the Lower Colorado River Authority's McNeil
to Georgetown transmission line; and
WHEREAS, the Lower Colorado River Authority has no
objections to the extension of Deepwood Drive; and
WHEREAS, the Lower Colorado River Authority has submitted an
agreement regarding said extension; and
WHEREAS, the Council of the City of Round Rock wishes to
enter into said agreement; NOW THEREFORE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK,
TEXAS
That the Mayor is hereby authorized and directed to enter
into said agreement with the Lower Colorado River Authority, a
copy of said agreement being attached hereto and incorporated
herein for all purposes.

This is in reply to your letter request dated March 12, 1987, for the
construction of the proposed extension of Deepwood Drive Northward to
R.M. 620, across and paralleling our McNeil to Georgetown Transmission
line No. T -136 between engineering station 408 +00 and 447 +00 in Williamson
County, Texas.
The above construction has been discussed with and checked by LCRA's
Engineering Department, and it has been determined that LCRA does not
have the right to grant you permission to construct said extension of
Deepwood Drive, however, assuming that you obtain appropriate permission
or easements from the property owners, the LCRA will have no objection
to said extension of Deepwood Drive if the following conditions are met:
1. The LCRA retains any and all of the original easement rights
granted to LCRA by Willie Hester recorded in Volume 334, page 433
Janie Ferrell recorded in Volume 334, page 437 and by Edward J.
Walsch, Sr., recorded in Volume 338, page 613 in the Deed Records
of Williamson County, Texas;
2. It may be necessary in the future that Authority, its successors
or assigns reconstruct, remove, or remodel said electric
structures, and it is understood, therefore, that Authority re-
tains any and all of its easement rights;
3. Power line clearance will be maintained in final grading beneath
the conductors;
4. The grade will be restored to its original state after said
extension of Deepwood Drive is completed;

5. During the construction of the extension of Deepwood Drive,
The City of Round Rock or their contractor will be held liable
for any damages to LCRA's structures and appurtenances;
6. You will save and hold LCRA harmless from any and all claims,
damages, causes of action, suits, judgments of any type what-
soever in favor of or against anyone whomsoever from use of
said easement area for any purpose other than intended.
If these conditions are agreeable to you please sign and date one copy
of this correspondence and return it in the enclosed envelope.
