THE COUNTY OF WILLIAMSON
* KNOW ALL MEN BY THESE PRESENTS
THAT Williamson County, Texas, hereinafter referred to as
"County ", and the City of Round Rock Fire Department,
hereinafter referred to as "District ", have entered into the
following:
AGREEMENT
1. Pursuant to it's power to provide financial assistance for
fire protection in and for Williamson County, and its duty to
protect the public health and welfare, the County agrees to
grant the District the sum of $4,124.80, in two (2) payments,
one on or before May 1, 1987 and one on or before October 1,
1987, to defray the cost of equipment and labor required to
provide the services described in paragraph 2.
2. District agrees to provide fire protection services in any
area in the county when requested by any other fire company, and
shall expend all of the grant amount for only these purposes
during the calendar year 1987.
3. It is understood by District that County cannot commit funds
for any future fiscal year, and that this Agreement does not,
and cannot, commit County to renew or repeat this grant unless
approved by future action of the Williamson County
Commissioners' Court.
4. It is understood and agreed that county has no power to
control or supervise the manner and means chosen by District to
carry out the services specified in Paragraph 2, and that county
shall have no liability for any of the acts of the district
(whether intentional, negligent or otherwise). County's role in
this Agreement begins and ends with the payment of the grant
described in Paragraph 1. District agrees to hold the County
harmless from any and all risk of loss from any acts or
omissions of the District, its officers, employees or agents.
District further agrees to indemnify the County for any loss or
expense (including but not limited to attorney's fees) incurred
as a result of a claim against the County by any person or
entity based on this Agreement or on any such act or omission.

5. It is understood that this Agreement is payment to the City
of Round Rock, Texas, for unspecified fire protection services
at the rate of eight cents ($.08) per acre covering
approximately 51,560 acres of land generally known the the Round
Rock Fire District.

SUBJECT: Rural Fire Protection Expenditures
As per our conversation regarding rural fire protection services
provided by this department, I have prepared this report to re-
flect expenditures involved in providing this service. A compar-
ison is based on this year's budget, which ends September 30, 1987.
An analysis was made as to the number of alarms inside the city
compared to those outside the city. This comparison was calculated
over this fiscal year which began October 1, 1986 and ends September
30, 1987. The following table indicates the alarm classification
and the percentage for the year:

The past year we responded to 1,215 alarms, with 105 occuring out-
side our city limits. The result is an average of 8% of the alarms

Rural Fire Protection Expenditures
The figure of $20,567.00 reflects an annual expenditure based on eight
percent (8 %) of portions of our annual budget. The city receives
$4,124.80 annually from the county for rural fire protection. The
annual figure does not reflect debt service on capital expenditures
or an annual payment for a fire truck.
As you can see, expenditures for rural alarms is more than the county
currently provides. It may also be noted that each year our operating
cost reflect an increase. In 1982 -83, the county increased it's yearly
contribution from $2,062.40 to $4,124.80 per year, and there has not
been an increase since that time.

ITEM: 13H - Consider a resolution authorizing the Mayor to
enter into an agreement with Williamson County for rural
fire fees.
The City has been receiving funds from the County in the
amount of $4,124.80 for rural fire protection at a rate of
18 an acre. This is the first year we have been asked to sign
a contract to receive these funds. The City Attorney can speak
on the legal aspects of this agreement.
