Gentlemen:
On April 20, 1987, bids were received on the Hwy. 620 water line and bore
project. A certified tabulation of the bids received is enclosed.
The low bid of $76,246.50 was submitted by the Robert Hurst Company, Inc. The
specified contract time for this work is 45 calendar days.
We have visited with their bonding agent and CPA regarding their financial
condition and their ability to perform the work. In addition, we have discussed
with owners their performance on similar projects currently under contract. In
our opinion, this contractor is qualified and capable of performing the work.
We have also checked the bid submitted by the Robert Hurst Company, Inc. and
find no qualifying statements or discrepancies except extension errors which did
not affect the total bid price. The bid was accompanied by proper bid security.
After considering the bids, we recommend the following procedure:
1. The City Council accept the low bid and award a contract for
construction of the Hwy. 620 water line and bore project to
the Robert Hurst Company, Inc. subject to execution of the
Construction Contract and Performance and Payment Bonds.
2. The City Attorney be authorized to prepare and /or review
the Construction Contract.
3. The Mayor be authorized to execute the Construction Contract
after the Contractor's bonds have been received and approved
by the City Attorney,
4. The Engineers be authorized to issue Notice to Proceed with
the work to the Contractor after the Contract has been exe-
cuted by the City.

AGREEMENT
Witnesseth: That for and in consideration of the payments and agreements here-
inafter mentioned, to be made and performed by the Party of the First Part
(Owner), and under the conditions expressed in the bonds bearing even date
herewith, the said Party of the Second Part (Contractor), hereby agrees with the
said Party of the First Part (Owner) to commence and complete the construction
of certain improvements described as follows:
16" Waterline and bore with related improvements as indicated on the attached
construction plans, Hwy. 620 @ I.H. 35.
and all extra work in connection therewith, under the terms as stated in the
General Conditions of Agreement; and at his (or their) own proper cost and
expense to furnish all the materials, supplies, machinery, equipment, tools,
superintendence, labor, insurance, and other accessories and services necessary
to complete the said construction, in accordance with the conditions and prices
stated in the proposal attached hereto, and in accordance with the General Con-
ditions of Agreement, and in accordance with the Plans, which includes all maps,
plats, blueprints and other drawings and printed or written explanatory matter
thereof, and the Specifications therefor, as prepared or approved by
Baker - Aicklen & Associates, Inc. herein entitled the Engineer, each of which
has been identified by the endorsement of the Contractor and the Engineer
thereon, together with the Contractor's written Proposal, the General Conditions
Agreement, and the Construction Bonds hereto attached; all of which are made a
part hereof and collectively evidence and constitute the entire contract.
The Contractor hereby agrees to commence work within five (5) days after the
date written notice to do so shall have been given to him, and to substantially
complete same within 45 (calendar) days after the date of written
notice to commence work.
The Owner agrees to pay the Contractor in current funds for the performance of
the contract in accordance with the Proposal submitted therefor, subject to
additions and deductions, as provided in the General Conditions of Agreement,
and to make payments on account thereof as provided therein.
