R-88-1078 - 1/14/1988ATTEST: C20RRISDRES E LAND, City Secretary RESOLUTION NO. /6 WHEREAS, the Round Rock Independent School District and the City of Round Rock wish to share the cost of assessing and collecting taxes, and WHEREAS, the Round Rock Independent School District has submitted a contract to the City for its approval, and WHEREAS, the Council of the City of Round Rock wishes to enter into said contract with the Round Rock Independent School District, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS That the Mayor is hereby authorized and directed to execute on behalf of the City, a contract with the Round Rock Independent School District which provides for the sharing of tax assessing and collection costs; a copy of said contract is attached hereto and made a part hereof for all purposes. ANN. art. 1066b (1963), TEX. PROP. TAX CODE § 6.24(a), and § 10.08 of the Round Rock City Charter, has by resolution duly adopted authorized the Tax Assessor and Tax Collector of the Round Rock Independent School District to act as Tax Assessor and Tax Collector for the City of Round Rock, Texas; and WHEREAS the Round Rock Independent School District has agreed that its Tax Assessor and Tax Collector may act as the Tax Assessor and Tax Collector respectively for the City of Round Rock, Texas, NOW THEREFORE, for and in consideration of the hereinafter stated promised and agreements, the following contract is entered into by and between the City of Round Rock, Texas, a Texas municipal corporation, hereinafter called the City, and the Round Rock Independent School District, an indepen- dent school district duly organized and existing under the laws of the State of Texas, hereinafter called the School District, as follows: Section 1. Term of Contract. This contract shall be effective from October 1, 1987 to September 30, 1988, provided however that the contract may be automatically renewed at the end of this term and annually thereafter by resolutions or ordinances approved and adopted by the governing bodies which are parties to this contract. Section 2. Tax Assessor and Tax Collector. The School District shall determine the qualifications of the Tax Assessor and Tax Collector and shall appoint the Tax Assessor and Tax Collector. Section 3. Tax Rate The Tax Assessor shall calculate and publish the effec- tive tax rate as required by Chapter 26 of the Texas Property Tax Code. The City shall determine and fix the tax rate to be applied to the property values for City taxes and shall notify the Tax Assessor of the tax rate adopted by the City no later than December 31 of each year. Section 4. Tax Collection. The Tax Collector shall mail tax notices to property owners whose property has been assessed for taxes and shall thereafter collect such taxes as may be paid. The Tax Collector shall pay into the depository of the City such taxes as may be collected as they are collected and shall perform other duties of a tax collector for the City. The Tax Collector shall furnish such tax certificates as may be required by law covering taxes due both the City and the School District to those applying for such certificates. In the event it becomes necessary to file suits for the collection of delinquent taxes due the City and the School District, the City shall be responsible for taking the necessary action to file and prosecute such suits for the collec- tion of the City taxes and the School District shall be respon- sible for taking the necessary action to file and prosecute such suits for the collection of the School District taxes. Section 5. Payments. The City shall pay the School District a fee which shall not exceed the actual cost incurred and shall be a percentage of the Tax Office Budget for expenditures. This percentage is to be based on a comparison of the total market value of properties on the City Tax Roll to the total market value of properties on the School Tax Roll. The fee shall not exceed $58,396.00 for the services to be performed under this contract. One - half of this fee shall be due and payable on or before February 1, 1988 and the remaining one -half of the fee shall be due and payable on or before April 1, 1988. Section 6. Tax Records. Upon the termination of this contract for any reason the City shall be entitled to reproduce such tax records of the School District's tax department as may be desired by City offi- cials. Such reproduction shall be furnished by the School District to the City with reasonable diligence and the City shall pay to the School District the cost of such reproduction. Appropriate officials of the City shall have access to the tax records of the School District during the period of this contract at reasonable times during normal office hours. Section 7. Subcontracting. The School District may subcontract with any person or entity to provide any of the services to be provided by the School District pursuant to this contract. Section 8. Time of Essence. Time is of the essence of this contract. Section 9. Severability. If any obligation or covenant of either party hereto shall ever be held invalid, the remaining provisions of this contract shall continue to be binding and enforceable. STAFF RESOURCE PERSON: Sam Huey STAFF RECOMMENDATION: Accept the contract as proposed. ECONOMIC IMPACT: This contract is identical to last year's contract except for the funding amount. The requested amount is $58,396, an increase of $9,232. This increase is due mainly to the re- location of the tax office to a new building at a cost of $12,158. This should be a one time cost and the corresponding reduction should be noted next year.
