Proposal for the City May 31, 1988
of Round Rock
As we have discussed with you over the past few months, the Bright
family intends to proceed with the donation of that portion of a lake
that lies on our property situated on a 213 acre tract owned by
Bright Farms, Inc., and the William R. Bright Testamentary Trust, as
shown in Attachment "A". Most of the aforementioned land to be donated
is located in an easement to the Brush Creek Water Control and Improve-
ment District #1, plus some to make the parcel more symmetrical.
As we have agreed, this donated acreage will count toward the manda-
tory donation of parkland required by the City of Round Rock when
the property is developed. As we have also discussed, our gift will
be contingent on the City of Round Rock Building and maintaining an
access to the lake for the livestock on our property, so that as long
as our property is used for agricultural purposes, livestock will
have access to the water.
We would now propose that the City of Round Rock pay all closing
costs associated with the donation. Collins Warren and Associates
of Austin have worked this property before and would therefore conduct
the appraisal more efficiently perhaps than another firm. Attachment
"B" is the estimate of the cost of the appraisal of $2,200.00.
The survey as you will note in Attachment "A", is almost complete.
All that remains is the survey of one line and the field notes.
The work has been and will be done by HaynieKallman Engineering.
We are agreeable to your own City Attorney, Steve Sheets, doining
the leagal work which our attorney will review. The Title Policy
may range between $800.00 and $1,600.00.
Based on the above, it is our estimate that the closing will not cost
more than $5,000.00. We would like to accomplish the transfer on or
before December 15, 1988, but not before December 1, 1988.
Your consideration of this matter will be greatly appreciated. It
is a pleasure to work with all of you on this project.

RE: An appraisal of a partial taking out of a 213.562 acre tract
of vacant land located on located on the north side of U.S.
Highway 79, Williamson County, Texas.
Dear Ms. Land:
Per our conversation today, you have requested that we prepare a
fee quote for appraising the above referenced property. It is
our understanding that the property to be appraised is a portion
of a 213.562 acre tract. Furthermore, we understand that the
area to be appraised is entirely within a flood control easement.
This will require that we appraise the entire 213.562 acre tract
and then arrive at a value for the partial taking. We will also
have to determine if there are any damages to the remainder after
the taking. Due to the scope of this type of appraisal and the
scarcity of comparable sales of similar properties, preparation
of this report will probably require extensive research.
Based on these considerations, COLLINS WARREN & ASSOCIATES, INC.
agrees to complete the appraisal for a fee not to exceed $2,200.
Upon acceptance of this assignment, we should be able to furnish
You with a completed report within four weeks.

RESOLUTION NO.
WHEREAS, the City of Round Rock desires to accept a donation of
certain real property owned by Bright Farms, Inc., and the William R.
Bright Testamentary Trust, and
WHEREAS, the owners of said property desire to make said
donation on the condition that the City agree to certain proposals as
set out in Exhibit "A", attached hereto; Now Therefore
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor of the City of Round Rock, Texas be hereby
authorized to sign said proposal, and thereby bind the City to
perform all conditions as set out in said proposal.

ITEM: 10C. Consider a resolution authorizing the Mayor to accept a proposal
submitted by Jean Bright Land.
STAFF RESOURCE PERSON: SHARON PRETE
STAFF RECOMMENDATION: StafE has requested the Bright Estate to donate
approximately 10 acres on the east side of the lake at old
Settlers Park at Palm Valley. This would allow the City
total ownership of the lake, thus eliminating potential
trespassing problems. Steve Sheets and I recommend that
Council enter into this agreement to pay for the appraisal„
survey,title policy and legal costs.
ECONOMIC IMPACT: Land costs in this area vary substantially and the appraisal
has not been completed, but the land valve would exceed
the cost to the City.
