Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor is authorized to execute on behalf of the City an
instrument releasing said Easement, said instrument being attached
hereto and incorporated herein for all purposes.

VACATION OF PUBLIC UTILITY EASEMENT IN THE MARKET AT ROUND ROCK
Whereas, Crow - Gottesman - Shafer #22, owner of Lot 1 and Lot 3 of Market
at Round Rock, a subdivision in the City of Round Rock, Williamson County,
Texas, as recorded in Cabinet H, Slides 187 & 188 of the Plat Records of said
County, and Pacific St. Leasing, Inc., a Texas corporation, owner of Lot 2 of
said subdivision, now desire to vacate a certain Public Utility Easement
recorded by instrument in Volume 1347, page 625 of the Williamson County Deed
Records; said easement being more particularly described in Exhibit "A"
attached hereto and made part hereof for all purposes, and the approval of the
City Council of the City of Round Rock, Texas, has been obtained for such
vacation, and the authorities of the City of Round Rock, Texas, have not made
any actual appropriation of any proposed dedication described in Volume 1347,
page 625, by entry, use or improvement which would be disturbed by this
vacation, and such vacation is authorized by law;
NOW THEREFORE, Crow- Gottesman - Shafer #22 and Pacific St. Leasing, Inc.
do hereby declare said Public Utility Easement, as described in Exhibit "A" to
be vacated;

STAFF RESOURCE PERSON: Joe Vining
STAFF RECOMMENDATION: Approval.
The attached vacation of a Public Utility Easement in the
Market At Round Rock requires Council approval due to the
fact that the original easement was dedicated by instrument
rather than plat.
This easement is NOT required and has, in fact, been replaced
by a revised easement which is recorded in Volume 1500, Page
353.
All utility companies and the Public Works Department have
approved the vacation of this unnecessary easement.
