desires to donate to the City of Round Rock 11.190 acres of property
located in the Joseph Marshall Survey, Williamson County, Texas, more
fully described in a Warranty Deed attached hereto as Exhibit "A ",
and
WHEREAS, the City Council is desirous of accepting said
donation, Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the property described in the Warranty Deed attached hereto
as Exhibit "A" is hereby accepted by the City of Round Rock.

WARRANTY DEED
That the THREE G PARTNERSHIP, a Texas general partnership,
hereinafter called "Grantor" for and in consideration of the sum of
Ten Dollars ($10.00) and other good and valuable consideration in
hand paid by the City of Round Rock, hereinafter called "Grantee ",
the receipt of which is hereby acknowledged, and for the payment of
which no lien, express or implied, is retained against the property
and premises hereby conveyed, h: GRANTED, SOLD and CONVEYED, and by
these presents does grant, sell and convey unto the City of Round
Rock the following described real property in Williamson County,
Texas together with all improvements thereon, to wit:
See Exhibit "A" attached hereto for a description of the
property herein conveyed.
As additional consideration, Grantee agrees that the conveyance
of the 11.170 acres described in Exhibit "A" above shall be credited
towards the parkland dedication requirements as set out in Chapter 8,
Section 6.0., Code Of Ordinances of the City of Round Rock, Texas,
for any other adjacent property developed in the future by Grantor or
their successors or assigns.
As further consideration, Grantee agrees to provide and maintain
an alternate source of water for livestock on Grantor's adjacent
property, so long as the adjacent property is used for agricultural
purposes. This alternate source shall consist of an electric pump
immersed in the adjoining lake which shall pump water into a water
trough located on Grantor's adjoining property.
To have and to hold the property, together with all and singular
the rights and appurtenances thereto in anywise belonging unto
Grantor, and Grantor's successors and assigns forever; and Grantor
does hereby bind Grantor and Grantors successors and assigns to
warrant and forever defend all and singular the property unto Grantee
and Grantee's successors and assigns against every person whomsoever
lawfully claiming or to claim the same or any part thereof, except,
however, that this conveyance is made subject to the liens securing
payment of ad valorem taxes for the current and all subsequent years
as well as to all easements of record in Williamson County, Texas, or
visible or apparent on the ground, and all restrictions, covenants,
and conditions which are applicable to the property.
