R-89-1222 - 1/20/1989WHEREAS, the Brushy Creek Water Control and Improvement District
No. 1 of Williamson and Milam Counties, the City of Austin and the
City of Round Rock, have previously entered into a Wastewater
Disposal Agreement ( "Agreement ") dated April 11, 1988; and
WHEREAS, said Agreement provides for the construction of certain
improvements referred to as the Onion Creek Interceptor Phase II, and
WHEREAS, Lomas Land, Inc. proposes, on behalf of Williamson
County MUD No.9, to construct a portion of said Onion Creek
Interceptor Phase II, and
WHEREAS, an Agreement Regarding Onion Creek Interceptor Phase II
Wastewater Line has been prepared, which agreement the City Council
wishes to enter into, Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City the Agreement Regarding Onion Creek Interceptor
Phase II Wastewater Line, a copy of said agreement being attached
hereto and incorporated herein for all purposes.

That the undersigned LEON E. BEHRENS (hereinafter called "Grantor"
whether one or more) for an in consideration of the sum of Ten Dollars
($10.00) and other good and valuable consideration in hand paid by Brushy
Creek Water Control and Improvement District (referred to as "Grantee "),
the receipt of which is hereby., acknowledged, has granted, sold and
conveyed and does hereby grant, sell and convey unto the said Grantee,
its Successors and assigns, a permanent right of way and easement for the
purpose of placing, constructing, operating, enlarging, repairing,
maintaining, inspecting, rebuilding, replacing, relocating and removing
wastewater lines together with all necessary appurtenances together with
a temporary construction easement for the purpose of installation of the
aforesaid facilities upon, across, along and through the land of Grantor
in Williamson County, Texas, and described as follows:
All that certain 235.25 acre tract of land described in a deed
to Leon E. Behrens, of record in Volume 443, Page 563 of the
Deed Records of Williamson county, Texas to which referenced is
here made for purposes of description and said easement being
more particularly described by metes and bounds in Exhibit "A"
attached hereto and made a part hereof for all purposes and for
more particular description.
The Grantor, its successors and assigns are hereby expressly given
and granted the right to assign this right of way and easement, or any
part thereof, or interest therein, and the same shall be divisible among
two or more owners, as to any right or rights created hereunder, so that
each assignee or owner shall have the full rights and privileges herein
granted, to be owned and enjoyed in common or severally.
The Grantee shall have all other rights and benefits necessary or
convenient for the full enjoyment or use of the rights herein granted,
including, but without limiting the same to, the free right of ingress
and egress over and across an existing road or driven path to and from
said right of way and easement; said road or path being described in
Exhibit "B" attached hereto.

Grantee, its successors and assigns forever. And the Grantor, whether
one or more, hereby bind ourselves, our heirs, executors, administrators

whomsoever lawfully claiming or to claim the same or any part thereof.
The undersigned Grantor, his heirs and assigns, reserves the right
fully to use and enjoy said premises except as the same may be necessary
for the purposes herein granted.
The Grantee, by the acceptance hereof, agrees to bury all pipelines
so that they will not interfere with the cultivation of the land and also
to pay for any damage to crops, fences and livestock which may arise for
laying, constructing, maintaining, operating, altering, repairing, remov-

To Have and To Hold said right of way and easement, unto said
Grantee, its successors and assigns forever. And the Grantor, whether
one or more, hereby bind ourselves, our heirs, executors, administrators
and assigns to warrant and forever defend all and singular said premises
unto the said Grantee, its successors and assigns, against ever person
whomsoever lawfully claiming or to claim the same or any part thereof.
The undersigned Grantor, his heirs and assigns, reserves the right
fully to use and enjoy said premises except as the same may be necessary
for the purposes herein granted.
The Grantee, by the acceptance hereof, agrees to bury all pipelines
so that they will not interfere with the cultivation of the land and also
to pay for any damage to crops, fences and livestock which nay arise for
laying, constructing, maintaining, operating, altering, repairing, remov-
ing, changing the size of, and replacing such lines. -

FIELD NOTE DESCRIPTION OF A 2.30 ACRE TRACT OF LAND, TO BE
USED AS A TWENTY (20) FOOT WIDE WASTEWATER EASEMENT, SITUATED IN THE
DAVID CURRY SURVEY, ABSTRACT 130, . WILLIAMSON COUNTY, TEXAS BEING
OVER AND ACROSS THAT CERTAIN 235.25 ACRE TRACT OF LAND DESCRIBED IN
DEED TO LEON E. BEHRENS OF RECORD IN VOLUME 443, PAGE 563, OF THE DEED
RECORDS OF WILLIAMSON COUNTY, TEXAS, SAID 2.30 ACRE TRACT BEING MORE
PARTICULARLY DESCRIBED BY METES AND BOUNDS AS FOLLOWS:
COMMENICNG, at a fence post found for the most southerly northwest ell
corner of the said 235.25 acre tract, and being the southwest corner of that certain
396.20 acre tract of land described in deed to Arline Rasmussen, Leroy L. Lange, of
record in Volume 407, Page 374, and Leroy & Ruth Lange and Harold & Arline
Rasmussen of record in Volume 515, Page 197, of the deed records of Williamson
County, Texas;
THENCE, with the east line of said 235.25 acre tract and the west line of
said 396.20 acre tract, N 200- 46' -03" W, a distance of 661.04 feet to the
POINT OF BEGINNING and being the southeast corner hereof;
THENCE, departing the west line of said 396.20 acre tract and over and
across said 235.25 acre tract, with the south line hereof, the following six (6) courses
and distances:
1. S 57 ° - 34' -15" W, a distance of 481.95 feet for an angle point,
2. S 79 ° - 15' -03" W, a distance of 850.73 feet for an angle point,
3. N 57 ° - 05' -46" W, a distance of 869.14 feet for an angle point,
4. S 66 ° - 56'-18" W, a distance of 745.71 feet for an angle point,
5. S 34 ° - 51' -16" W, a distance of 939.00 feet for an angle point, and

which a concrete monument found for the point of curvature of said
120.0 foot right -of -way, bears a distance of 607.52 feet along the arc
of a curve to the left, and the chord of which bears N 81 ° - 17' -03" E, a
distance of 599.93 feet;
THENCE, with the south line of said 235.25 acre tract, the north line of said
120.0 foot right-of-way and the south line hereof, a distance of 21.58 feet along the arc
of a curve to the right, the radius of which is 1372.39 feet, the central angle of which is
00 and the chord of which bears N 85 W, a distance of 21.58 feet to a
point for the most westerly corner hereof; -
THENCE, departing the curving north right-of-way line and over and across
said 235.25 acre tract, with the north line hereof, the following six (6) courses and
distances:
1. N 26 ° - 24' -51" E, a distance of 1129.10 feet for an angle point,
2. N 34 ° - 51' -16" E, a distance of 946.22 feet for an angle point,
3. N 66 ° - 56' -18° E, a distance of 762.09 feet for an angle point,
4. S 57 ° - 05' -46" E, a distance of 871.76 feet for an angle point,
5. N 79 ° - 15' -03° E, a distance of 838.89 feet for an angle point, and
6. N 57 ° - 34' -15" E, a distance of 482.25 feet to a point for the northeast
corner hereof, being also in the east line of said 235.25 acre tract, and
being in the west line of said 396.20 acre tract;
THENCE, with the east line of said 235.25 acre tract, the west line of said
396.20 acre tract and the east line hereof, S 20°- 46' -03" E, a distance of 20.42 feet to
the POINT OF BEGINNING and containing 2.30 acres of land.
TOGETHER WITH a temporary 20.00 to 65.00 foot varying width
construction easement lying parallel and adjacent to the north and south lines hereof.
