Round Rock Wastewater Service Agreement with the City of Round Rock,
and
WHEREAS, all parties now desire to postpone the readvertising of
bids until May 1, 1989, and
WHEREAS, the letters of credit previously deposited with the City
under the terms of the Agreement will soon expire,
WHEREAS, the landowners have agreed to deposit substitute letters
of credit, NOW THEREFORE
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor be and is hereby authorized to execute an Addendum
to, the Southwest Round Rock Wastewater Service Agreement, a copy of
said Addendum being attached hereto and incorporated herein for all
purposes.

contract and acknowledge the validity of said contract as hereby
amended.
Article IV of said Agreement is hereby amended to provide that
the Landowners shall, prior to the expiration date of the letters of
credit previously deposited with the City, deposit substitute letters
of credit in the same amount with an expiration date of not sooner
than May 1, 1989. Landowners acknowledge that failure to so deposit
said substitute letters of credit will result in the letters of
credit now on deposit to be presented by the City for payment. In the
event that the letters of credit currently on deposit are cashed,
Landowners shall be entitled to a return of the cash upon depositing
said substitute letters of credit.
Unless an earlier date is agreed to by all Landowners, the City
agrees not to readvertise for bids prior to May 1, 1989.
