WHEREAS, the City Council has determined that the health, safety,
and convenience of the traveling public requires a new roadway from
the interesection of Tellabs Drive and Jeffrey way south to Greenhill
Drive and
WHEREAS, while most of the affected landowners have agreed to
donate the needed right -of -way, one or more landowners have not yet
done so, and
WHEREAS, the Council wishes to authorize the City Staff to begin
the preliminary preparation to acquire the needed right -of -way by
eminent domain, Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the City Manager is authorized to proceed with the
preliminary preparation to acquire the right -of -way for the above -
described roadway by eminent domain.

16K. Consider a resolution authorizing the staff to
proceed with condemnation on an unnamed
thoroughfare in Crystal Park.
STAFF RESOURCE PERSON: Joe Vining.
STAFF RECOMMENDATION: Efforts to have approximately .62 acres
of land dedicated for right -of -way in the Crystal Park
Subdivision have been unsuccessful. It is recommended that
staff be authorized to acquire the land by condemnation.
The right -of -way would allow construction of a new north -
south collector from Amorron Park through the B. J. Hughes
property to Crystal Park. This road is required to provide
access to the south from this industrial area once the IH -35
frontage roads are converted to one way.

Confirming our conversation on this date it is agreed that the
time limit for your execution and return of the referenced contract
is extended to October 20, 1989.
Also, it is understood that special taxes are to be pro -rated for

Round Rock. You accepted the offer of $27,007.20 for
the 0.62 acres this past July and were kind enough to
visit with us in September. Your help in concluding
this matter will be appreciated. If I don't hear from
you soon, I will be left with no choice but to have
the City condemn the right -of -way.

Thank you for your letter of July 17, 1989. We accept your offer
of $27,007.20 for approximately 0.62 acres of land out of and a
part of Lot 1, Block B, Crystal Park, Round Rock, Williamson
County, Texas. This acceptance is subject to reaching a final
agreement on routing and details of the street to be located in the
subject right of way.
Bob, as suggested in my letter of May 18, 1989 we feel that it is
critically important for the City of Round Rock to assume an active
role in making development possible in the areas such as Crystal
Park which are within special road districts. In this regard I
would like to meet with you to review alternative approaches.
Please advise when you would be available.

The City of Round Rock recently had an appraisal "done
on 0.62 acres of land out of and a part of Lot 1, Block
B, Crystal Park, Round Rock, Williamson County, Texas.
The City is willing to offer you $1.00 per square foot
or $27,007.20 for the property. As you may recall,
this property will be used as right -of -way for a new
road that will run north /south and service industry
already located in the area. Due to the tight time
schedule we are working under, an answer from you
before July 26th would be greatly appreciated. Our
City Council meets on July 27th and I wish to be able
to address this item. Please call me if you need
further clarification.
