R-89-1288 - 5/25/1989WHEREAS, Clarence and Arnold Tealander are the owners of approximately 1.935 acres of land located in the Joseph Marshall Survey; and WHEREAS, the City of Round Rock, Texas, is the owner of approximately 2.416 acres of land located in the P. A. Holder Survey, Williamson County, Texas; and WHEREAS, in accordance with Section 272.001, Local Government Code, V.T.C.A., the Council finds that the 2.416 acres owned by the City cannot be used independently as zoned or under applicable subdivision ordinances because of its size and shape; and WHEREAS, pursuant to Section 253.001(b), Local Government Code, V.T.C.A., the issue of the sale or exchange of the 2.416 acres owned by the City was submitted to the qualified voters of the City at an election held on May 7, 1988; and WHEREAS, the majority of the qualified voters at said election voted to allow the City to sell or exchange said 2.416 acres, and WHEREAS, the City now desires to exchange its 2.416 acres for the 1.935 acres owned by the Tealanders, Now Therefore, BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the Mayor is hereby authorized and directed to sign on behalf of the City an exchange deed conveying the above described 2.416 acres for the 1.935 acres owned by Clarence and Arnold Tealander. Consider a resolution authorizing the Mayor to sign an Exchange Deed conveying 2.416 acres of land owned by the City of Round Rock for 1.935 acres of land owned by A. Tealander. STAFF RESOURCE PERSON: Jim Nuse STAFF RECOMMENDATION: Staff recommends the Mayor to be authorized to sign the Exchange Deed. These properties are located east on Highway 79 on the southside of the Union Pacific Railroad. ECONOMIC IMPACT: The City property is unsuitable for City use in that it is bounded by the Union Pacific Railroad and a farmed field with poor access. The 1.935 acres to be obtained is the entrance to our East Sewer Plant.
