R-89-1294 - 6/8/1989WHEREAS, the City Council has determined that the downtown water
tank located at 200 Round Rock Avenue is in need of repair because of
unforeseen damage, said repair being necessary to preserve and
protect the public health and welfare of the City's residents; and
WHEREAS, Steelbilt has submitted a proposal to provide said
repairs; and
WHEREAS, the City Council desires to enter into an agreement
with Steelbilt; Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor is authorized and directed to execute, on behalf
of the City, an agreement with Steelbilt to repair the downtown water
tank located at 200 Round Rock Avenue, said agreement attached hereto
and incorporated herein as Exhibit "A ".

That this Agreement made and entered into this 1 / y — day

TEXAS, its Mayor, First Party, hereinafter termed the Owner, and
STEEL BILT of the City of Round Rock,County cif Williamson, State of
Texas, Second Party, hereinafter termed Contractor.
WITNESSETH: That for and in consideration of the payments
and agreements hereinafter mentioned to be made and performed by said
First Party (Owner), the said Second Party (Contractor) hereby agrees
with the First Party to commence and complete the construction of
certain improvements at the prices set forth in the Contractor's Proposal
dated April 28, 1989 for certain improvements described as follows:
WATER SUPPLY PIPE REPLACEMENT
The Contractor shall perform all work shown on the Plans
and described in the Contracts and shall meet all requirements of this
Agreement, and such may subsequently be entered by the above named
parties to this Agreement.
The Contractor hereby agrees to commence work under this
contract within 10 consecutive calendar days after the date written
notice to do so shall have been given to him and shall cause work to
progress in a manner satisfactory to the Owner. Such work shall be
completed in full by 41141y 31, V161,
The Owner agrees to pay the Contractor in current funds, and to
make payments on account, for the performance of the work in
accordance with the Contract, at the prices set forth in the Contractor's
Proposal, sub to additions and deductions, all as provided in the
General Conditions of the Agreement.
IN WITNESS WHEREOF the Partials to these presents have executed this
Agreement in the year and day first above written.

Water Supply Pipe Replacement on the downtown elevated tank. Your
bid of $6,774.00 has been accepted by the City of Round Rock, Texas.
(The City is a tax exempt organization).
All work will be in accordance with the proposal dated April 28, 1989 and
the current City of Round Rock specifications before final acceptance
and payment will be made. You are required to arrange a preconstruction
conference Early-eight (48) hours prior to start up of work.
Plasm sign and return the attached agreement form. The City will also
require you to supply a certificate of insurance similiar to the form also
attached to this letter.
Failure to comply with these conditions within ten (10) days will entitle
the City of Round Rock to consider your bid abandoned. Please have

by freezing. This project will replace this pipe. The costs for
this repair will be forwarded to our insurance company.
