BOX 570 GEORGETOWN, TX 78627 (512) 869 -4386 MEMO TO: MEMBER GO RNMENTS OF THE HEALTH DISTRICT FROM: CLAREN 4� OVAN, M.D. DIRECTOR SUBJECT: MODIFICATION OF COOPERATIVE AGREEMENT March 12, 1990 Article 15 of our cooperative agreement states: "Modification of this Agreement shall be in writing and effective upon approval by a majority of the member governments." The purpose of this memo is to get your approval for the modification of Article 3. Article 3 now reads in part as follows: "The members of the BOARD shall have resided in the DISTRICT for a period of three (3) years..." The Board of Health has received a formal request from the City of Georgetown to allow each city to pick its representative without regard to length of residence. (See attached letter from Mayor Kennedy). Article 3 also contains the sentence: The order of yearly reappointments shall be determined by lot at the first BOARD meeting." Since this has already been done, we can drop this sentence from Article 3 as well. Attached is a copy of the original Article 3 and the proposed new Article 3. Also on the sheet is a place where you can indicate your vote. If you have any questions, you can either call me or talk to your representative to the Board. Darlene Lacy was there to represent the City of Georgetown. Ms. Lacy brought to our attention the fact that the Cooperative Agreement which all of the Cities signed, clearly states in Article 3, that an appointee to the Board must have resided in Williamson County at least three years (see attached). Ms. Lacy has not been in the County for three years. As 1 see it the City of Georgetown now has two options: Option #1: Honor the original agreement as signed and appoint a new representive to the Board. Option #2: Write a letter to the Board, care of the above address, and request that the Board modify the cooperative agreement to allow each city to pick its representative without regard to length of residence. Please let us know as soon as possible which option you prefer to pursue. if you have any questions or wish to discuss this matter further, please let me know. Thank you. The members of the BOARD shall have resided in the DISTRICT for a period of three (3) years and shall serve without compensation. All members shall be appointed for a three year term. Reappointments to the BOARD will be staggered so that only one third of the BOARD is up for reappointment in any one year. A member may be removed from the BOARD for neglect of duty, malfeasance, or unbecoming behavior by majority vote of the ruling body of the member government originally making the appointment. All vacancies caused by - death, resignation or removal of a member shall be filled for the unexpired portion of the term by the appointing bodies as above prescribed. Consider a resolution authorizing the modification of the Cooperative Agreement for Williamson County Health District. STAFF RESOURCE PERSON: Joanne Land STAFF RECOMMENDATION: The Council currently has an agreement with other cities in Williamson County relative to the Williamson County Health District. The City of Georgetown has requested that the residency requirement for board members be amended. Currently a board member must live in the county three years prior to being eligible to serve on the board. Georgetown would like to remove the three year residency requirement because of a qualified professional they appointed who has lived in the county less than three years. The City's board representative, the Health District Director and the other cities are in favor of the change. Staff recommends approval of the resolution.
