V.A.T.S., the City of Round Rock desires to co- operate with the State
of Texas in encouraging and assisting disabled persons to achieve
personal independence by engaging in useful and productive activities;
and
WHEREAS, in order to achieve this goal, the City desires to enter
into a contract with Texas Industries for the Blind and Handicapped
for mowing services in consideration for the payments outlined in said
contract, Now Therefore,
BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS,
That the Mayor is hereby authorized and directed to execute on
behalf of the City a contract with Texas Industries for the Blind and
Handicapped for mowing services in consideration for the payments
outlined in the contract, a copy of said contract is attached hereto
and incorporated herein for all purposes.

This contract and agreement is entered into by and between the City of Round
Rock and the Performing Party, (Brush Country Industries) pursuant to the
authority granted in compliance with the provisions of Chapter 122, Human
Resources Code, and certified by Texas Industries for the Blind and Handicapped,
(TIBH) as a contract in compliance with the provisions of Chapter 122, Human
Resources Code.
I. CONTRACTING PARTIES:

Performing Party (Assigned Sheltered Workshop): Brush Country i

II. STATEMENT OF SERVICES TO BE PERFORMED: Clean City Lots /See attached
specifications.
III. BASIS OF PAYMENT: Payment will be on the basis of $8.00 per man
hour (includes all labor, equipment, and materials) on a'
pre- approved work order form.
IV. PAYMENT FOR SERVICES:
The Receiving Party shall pay for services received upon receipt of
a proper invoice or voucher prepared by thn Assigned Sheltered
Workshop or TIBH within 30 days from receipt of same.

This contract is to begin September 17 , 19 90 , and shall be
reviewed annually or upon request of any of the contracting parties.
THE UNDERSIGNED PERTIES do hereby certify that, (1) the services
specified above are necessary and essential for activities that are
properly within the statutory functions and programs of the affected
parties of Local and State Government, and (2) the services,
supplies or Contract, are not required by Section 21 of Article XVI
of the Constitution of Texas to be supplied under Contract given to
the lowest responsible bidder.

STAFF RECOMMENDATION:
Please see the enclosed booklet with contract. Public Works was
disappointed with the service provided by TIBH under our current
contract. TIBH was overextended contractually. Brush Country
has the manpower and resources to provide this service. I
recommend that the council enter into this agreement for 6 months
to evaluate the progress.
