BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS
That the Mayor is hereby authorized and directed to execute on
behalf of the City, a contract with the Round Rock Independent School
District which provides for the collection of all City taxes, a copy
of said contract is attached hereto and made a part hereof for all
purposes.

WHEREAS, the City of Round Rock, Texas, by the authority of TEX.
REV. STAT. ANN. art. 1066b (1963), TEX. PROP. TAX CODE § 6.24(a) and
§ 10.08 of the Round Rock City Charter has, by resolution duly

adopted, authorized the Tax Assessor and Tax Collector of the Round
Rock Independent School District to act`as Tax Assessor and Tax
Collector for the City of Round Rock, Texas; and • ;
WHEREAS, the Round Rock Independent School District has agreed
that its Tax Assessor and Tax Collector may act as the Tax Assessor
and Tax Collector respectively for the City of Round Rock, Texas,
NOW, THEREFORE, for and in consideration of the hereinafter
stated promises and agreements, the following contract is entered into
by and between the City of Round Rock, Texas, a Texas municipal
corporation, hereinafter called the "City ", and the Round Rock
Independent School District, an independent school district duly
organized and existing under the laws of the State of Texas,
hereinafter called the "School District ", as follows:
Section 1. Term of Contract.
This contract shall be effective from October 1, 1990, to
September 30, 1991, provided, however, that the contract may be
automatically renewed at the end of this term and annually thereafter
by resolutions or ordinances approved and adopted by the governing,
bodies which are parties to this contract.

Section 2. Tax Assessor and Tax Collector.
The School District shall determine the qualification of the Tax
Assessor and Tax Collector and shall appoint the Tax Assessor and Tax
Collector.
Section 3. Tax Rate
The Tax Assessor shall calculate the effective tax rate as
required by Chapter 26 of the Texas Property Tax Code. The City shall
determine and fix the tax rate to be applied to the property values
for City taxes and shall notify the Tax Assessor of the tax rate
adopted by the City no later than September 30 of each year.
Section 4. Tax Collection.
The Tax Collector shall mail tax notices to property owners whose
property has been assessed for taxes and shall thereafter collect such
taxes as may be paid. The Tax Collector shall pay into the depository
of the City such taxes as may be collected as they are collected and
shall perform other duties of a tax collector for the City. The Tax
Collector shall furnish such tax certificates as may be required by
law covering taxes due both the City and the School District to those
applying for such certificates.
Section 5. Delinquent Taxes
The City retains the right to employ legal counsel for the
collection of delinquent taxes.
Section 6. Payments.
The City shall pay the School District a fee which shall not
exceed the actual cost of providing the services under this contract
being agreed herein to be $1.80 per each current tax account (based on

current accounts as of September 1, 1990). At this rate the fee for
1990 -91 will be $26,688.60. One -half of this fee shall be due and
payable on or before February 1, 1991, and the remaining one -half of
the fee shall be due and payable on or before April 1, 1991.
Section 7. Tax Records.
Upon the termination of this contract for any reason the City
shall be entitled to reproduce such tax records of the School
District's tax department as may be desired by City officials. Such
reproduction shall be furnished by the School District to the City
with reasonable diligence and the City shall pay to the School
District the cost of such reproduction. Appropriate officials of the
City shall have access to the tax records of the School District
during the period of this contract at reasonable times during normal
office hours.
Section 8. Subcontracting.
The School District may subcontract with any person or entity to
provide any of the services to be provided by the School District
pursuant to this contract.
Section 9. Time of Essence.
Time is of the essence of this contract.
Section 10. Severability.
If any obligation or covenant of either party hereto shall ever
be held invalid, the remaining provisions of this contract shall
continue to be binding and enforceable.
EXECUTION of the contract constitutes ratification of the
effective dates set out hereinabove. This agreement is signed and

The Round Rock ISD contract for toll- tior of property taxes with the
City of Round Rock will expire at the end of September. Enclosed are
two copies of the new contract for the year October 1, 1990, through
September 30, 1991. _ When approval and signatures have been obtained,
please return one copy to us for our files.
This contract contains two changes from the previous instrument.
These changes, which have been under discussion for some time between
the Tax Assessor, Forrest Child, and the City Finance Director and
City Manager, are (1) to change the manner of fee charged from a per-
centage basis to a per parcel basis and (2) to utilize the services of
only one delinquent tax firm for collection of city and school
district taxes. These changes bring the contract more in line with
similar contracts drawn by other taxing entities and will result in
considerable savings to the city in the fee,charged for collection
