R-91-1560 - 2/14/1991WHEREAS, the City of Round Rock wishes to implement a recycling program, and WHEREAS, certain services are needed to properly implement such a program, and WHEREAS, Round Rock Recyclers has submitted a proposal to provide the needed services, and WHEREAS, the City Council wishes to accept said proposal, Now Therefore BE IT RESOLVED BY THE COUNCIL OF THE CITY OF ROUND ROCK, TEXAS, That the aforesaid proposal is hereby approved and the Mayor is hereby authorized to execute on behalf of the City a contract with the Round Rock Recyclers to provide the necessary recycling services. ATTEST: NE LAND, City Secretary RS02141F Ativ liu RESOLUTION NO. 15 [ll V R MIKE ROBINSON, Mayor City of Round Rock, Texas GCRECYCLING and Recycling Services Agreement This Recycling Services Agreement ( "Agreement ") is made and entered into this 14th day of February, 1991, by and between the City of Round Rock, Texas ( "City "), a Texas home rule city and Round Rock Recyclers ( "Recyclers "), a Texas general partnership. Purpose of Agreement The purpose of this Agreement is to state the terms and conditions under which Recyclers will provide recycling services for the City. Now Therefore, in consideration of the mutual promises herein contained, the parties hereto agree as follows: (1) Services To Be Performed Recyclers agrees to perform and /or provide the following recycling services: (a) supervised personnel from 10:00 a.m. to 3:00 p.m., Tuesday through Saturday (except for City recognized holidays) to adequately man a recycling drop -off center and sorting station, and to unload and sort materials delivered to the site, and to transport recyclable materials off the site, (b) to accept all recyclable materials, which shall include, but not limited to, metal containers, glass containers, newspaper, paper and cardboard, (c) supervised personnel for a pilot residential curbside collection service in an area to be designated by the City, (d) marketing, education, media and fundraising support in order to maximize citizen participation. (2) Trash and Non - recyclable Material The City agrees that all trash and non - recyclable material that result from the sorting process will be the City's responsibility to haul away. (3) Location of Recycling Center The City shall provide an adequate site for the recycling center. It is presently anticipated that the site will be at the future public works yard site located on Deep Wood Drive, but City reserves the right to designate some other location at its sole discretion. (4) Materials and Supplies The City agrees to provide a portable building and adequate storage bins and trash receptacles and Recyclers agrees to furnish all other necessary materials and supplies necessary to perform the recycling services. (5) Supervision Recyclers will provide necessary supervision to ensure that all services that are agreed to be provided are performed properly. (6) Compliance With Applicable Statutes, ordinances, and Regulations In performing the services required of it under this Agreement, Recyclers shall comply with all applicable federal, state, county, and city statutes, ordinances, and regulations. (7) Insurance Recyclers will carry complete and adequate worker's compensation, public liability, and property damage insurance, and shall provide the City with a certificate of insurance naming the City as an additional insured. (8) Compensation Recyclers shall receive no compensation from the City but shall be entitled to keep all proceeds from the sale of recyclable materials. (9) Independent Contractor Recyclers agrees that it is an independent contractor of the City and neither it nor any of the personnel shall be considered as employees of the City, nor shall they represent themselves to anyone as employees of the City. (10) Term of Agreement The term of this Agreement shall commence on the 16th day of February, 1991 and shall continue in full force and effect until February 29, 1992 unless terminated sooner by thirty (30) days' written notice from either party to the other. (11) Subcontract of Responsibilities Recyclers shall have the right to subcontract a portion of its responsibilities to the Disabled Recyclers of Texas, Inc. and /or ResCare Services, Inc., but shall not subcontract with any other person or entity without the prior written consent of City. (12) Miscellaneous Provisions (a) Texas Law to Apply: This Agreement shall be construed under and in accordance with the laws of the State of Texas, and all obligations of the parties created hereunder are performable in Williamson County, Texas. 3 ATTEST: (b) Parties Sound: This Agreement shall be binding upon and inure to the benefit of the parties hereto and their respective heirs, executors, administrators, legal representatives, successors and assigns where permitted by this Agreement. (c) Legal Construction: In case any one or more of the provisions contained in this Agreement shall for any reason be held to be invalid, illegal, or unenforceable in any respect, such invalidity, illegality, or unenforceability shall not affect any other provision thereof and this Agreement shall be construed as if such invalid, illegal, or unenforceable provision had never been contained herein. (d) Prior Agreements Superseded: This Agreement constitutes the sole and only agreement of the parties hereto and supersedes any prior understandings or written or oral agreements between the parties respecting the within subject matter. Consider a resolution authorizing the Mayor to enter into an agreement for recycling. STAFF RESOURCE PERSON: Jim Nuse STAFF RECOMMENDATION: The City of Round Rock, Res Care Services and Round Rock Refuse are joining together to provide a recycling center at the Public Works Yard site on Deepwood Drive. The site will be opened from 10:00 a.m. to 3:00 p.m. Tuesday through Saturday. The center will accept cans, paper and glass. The center will open on Saturday, February 16, 1991. No trash will be accepted. Res Care Services will operate the site with a group of mildly retarded men who will assist citizens with unloading, and sort, and take the materials to market. All profits from the operation go to these men who have formed their own business. The center will be a drop off only, no payment will be made for recyclables which are dropped off. Round Rock Refuse is providing containers and limited hauling free of charge. Within a short period of time, the center hopes to accept brush, waste oil, and batteries. The City will chip the brush and use it for mulch, a waste oil redemption service will provide a free tank for collection of waste oil, and a battery reclaimer will provide a service for used battery disposal. These additional services must meet State requirements for spill containment. After the center has been opened for a while, a pilot program for curbside recycling will begin. This program will involve Round Rock Refuse and Res Care Services and hopefully this program will evolve to collection for the entire City. The Environmental Talk Force will focus on this program and assist in its development. Again, the center will open February 16, 1991. The City mulched over 1,000 christmas trees in our first year of the service, so we hope this recycling effort will be a great success. '
